Quando nos propusemos fazer este trabalho visámos, sobretudo, elevar a discussão da participação pública em sede de contratação pública, uma vez que, na nossa primeira análise e estudo sobre o tema, verificámos, não só a pouca densidade dessa participação, como também o parco debate sobre esta questão, que, na nossa perspetiva, muito interesse tem para o direito da contratação pública.
O nosso trabalho pretende dissecar a configuração e implicações que a decisão de contratar detém no nosso regime de contratação pública, tendo em vista saber se a participação pública existe neste patamar inicial da formação de um contrato público. Com efeito, o nosso objetivo passa por fazer a leitura dos diversos regimes,
nos quais, não obstante a intervenção pública, o direito de participação pública constitucionalmente existente está (devidamente) protegido e, em confronto, denunciar essa ausência de proteção no regime do Código dos Contratos Públicos.
Deste modo, guia-nos a pretensão de avaliar aquelas disposições e, consequentemente, indagar de a permeabilidade das mesmas serem adaptáveis ao regime do referido Código. No fundo, analisar o respeito das normas do Código dos Contratos Públicos, referentes à decisão de contratar, ao disposto na Constituição
da República Portuguesa quanto ao direito de participação pública.
Por fim, o estudo aproveitará e beneficiará do contexto em que é escrito, uma vez que coincide com a apresentação da proposta de nova redação do Código dos Contratos Públicos, resultante da transposição da Diretiva 2014/24/UE do Parlamento Europeu e do Conselho de 26 de fevereiro de 2014 e, nessa medida,
possibilitará adquirir uma perceção da direção que o legislador vai tomar quanto a esta matéria no Código reformado.
When we decided to do this work we aimed, above all, to elevate the discussion of public participation within the framework of public procurement, since, in our first analysis and study on the subject, we verified not only the low density of that participation, as also the meagre debate on this issue, that, in our perspective, has a lot of interest for public procurement law. Our work intends to dissect the configuration and implications that the decision to contract has in our public procurement regime, in order to know if the public participation exists in this initial level of the formation of a public contract. In fact, our aim goes by doing the reading of the various regimes, in which, despite public intervention, the constitutionally existing right of public participation is (properly) protected and, in contrast, to denounce this lack of protection in the regime of the Public Contracts Code. In this way, we are guided by the pretension to evaluate those dispositions and, consequently, to inquire of their permeability to be adaptable to the regime of the referred Code. In essence, analyze the respect of the rules of the Public Contracts Code, regarding the decision to contract, to the provisions of the Constitution of the Portuguese Republic regarding the right of public participation. Finally, the study will take advantage of and benefit from the context in which it is written, since it coincides with the presentation of the proposal of new wording of the Public Contracts Code, resulting from the transposition of Directive 2014/24/EU of the European Parliament and of the Council of 26 February 2014 and, to that extent, will make it possible to acquire a perception of the direction that the legislator will take regarding this matter in the reformed Code.
