Com este trabalho, pretende-se fazer um estudo geral sobre as relações entre a paremiologia e o Direito. A relação daquela com o Direito popular, apesar de ser um bom ponto de partida, não esgota a tese que se apresenta. Na verdade, importante olhar com especial interesse para as decisões dos tribunais superiores portugueses, na medida em que se pretende descobrir até que ponto estão os nossos juízes interessados nestas matérias paremiológicas.
A utilização concreta em decisões judiciais, constitui na verdade uma realidade inegável, que não se pode ignorar. Os provérbios são utilizados, repetidos, trabalhados nas mais diversas instâncias, pelos mais diversos actores e sobre as mais diferentes matérias jurídicas.
Por outro lado, explica-se que os provérbios são constituídos por previsão e estatuição, enquanto simultaneamente dotados de generalidade e abstração. Dessa maneira se chega à defesa da ideia de serem as normas jurídicas provérbios eruditos.
Para além disso, explica-se que longe de ser uma matéria desconectada da realidade académica, os estudos paremiológicos tendem a ser valorizados como autênticas escolas de sabedoria, lições para a vida em sociedade. O ensino destas matérias revela, pois, uma importância crescente, sobretudo para combater o mundo de informação voraz de hoje.
Acresce a importância que ao nível das relações interculturais têm, pois diversos povos apresentam diferentes expressões proverbiais. Do mesmo modo, são importantes para se entender as diversas áreas do conhecimento, o que lhes confere uma multidisciplinaridade ímpar. Na verdade, apesar de serem frases curtas, as expressões populares são ricas em ciência e em saber.
Assim, defende-se que o estudo das matérias proverbiais deve ser feito inclusivamente no mundo académico jurídico, para acompanhar a realidade dos tribunais e para facilitar o conhecimento do próprio Direito. Na verdade, não só a paremiologia pode servir para conhecer as práticas judiciais da actualidade, como constitui uma riqueza para o ensino que se tem de revelar.
With this work, it is intended to make a general study about the relationship between Law and paremiology. The strong link to the Popular Law, despite being a good starting point, does not exhaust the thesis that is to be study. In fact, it is given a special attention to the decisions made at the Portuguese higher courts, to understand what are the uses made by the the judges and to see if they are interested in this paremiological studies. The use of popular expressions at Portuguese Case Law is a reality that can not be ignored. The proverbs are used, repeated, worked on in several levels, by various actors, such judges and interested, one the most diferente legal mathers. On the other hand, it is explained that the proverbs are constituted by prediction and statuition, while simultaneously endowed with generality and abstraction. It is because of this, that is here defend that the legal rules are also proverbs, but scholars proverb. In addition, it is explained that far from being a matter disconnected from academic reality, the paremiological studies tend to be valued as wisdom schools, lessons for life in society. The teaching of this subjects is therefore of increasing import, particularly in order to path through the voracious and connected world of today. Most important, is the importance of this to the intercultural relations, beacause different people have different proverbial expressions. In the same way, they are important to understand different areas of knowledge, which gives them a unique multidisciplinarity. In fact, although they are short sentences, the proverbs are full of science and full of knowledge. With this said, it is my understand that the study of proverbs should be done even at the faculties of law, to follow the reality of the courts and even to understand the law itself. In fact, not only the paremiology could be used know the judicial practices of today, but it is also important for the teaching of Law.
