A democracia está em constante transformação. O desenvolvimento democrático está intimamente ligado à evolução social. O poder e o governo do povo, pelo povo e para o povo, são objetivos constitucionais alcançados com o auxílio da atuação jurisdicional. A Constituição, como a lei maior de uma nação soberana, prevê o controle das eleições através do Poder Judiciário. Este Poder, por sua vez, utilizando as regras e princípios responsáveis pela regulação do contencioso eleitoral, fiscaliza as eleições em todos os seus níveis. Todavia, a questão que se revela pertinente é saber se as judiciais decisões fundamentadas unicamente em princípios são verdadeiramente benéficas para a democracia. Na perspectiva portuguesa e brasileira, o estudo dos princípios no contencioso eleitoral revelará a sua importância democrática e a consequência de sua má utilização.
The democracy is constant transformation. The democratic development is closely related to social evolution. The power and the government of the people, by the people and for the people, are constitutional targets achieved with the support of the jurisdictional acting. The Constitution, as the highest law of a sovereign nation, provides the control of the elections by the Judicial Power. This Power, on the other hand, using the rules and principles responsible for the regulation of the electoral contentious, supervises the elections at all levels. However, the most relevant question is whether the judicial judgments based only on principles are truly beneficial to democracy. Under the Portuguese and the Brazilian perspective, the study of the principles in electoral contentious reveals their democratic importance and the consequence of their misuse.
