A presente dissertação traça uma jornada histórica da evolução do direito do trabalho, desde as primeiras revoluções industriais até a atualidade, evidenciando as profundas transformações sociais, econômicas e, sobretudo, jurídicas que ocorreram nesse percurso. A cada nova era industrial, novas demandas e desafios surgiram, exigindo constantes adaptações do ordenamento jurídico trabalhista para acompanhar as mudanças e garantir a proteção dos direitos dos trabalhadores. Com o advento da era digital e a crescente importância das tecnologias na relação laboral, a proteção dos dados pessoais dos trabalhadores tornou-se um tema central e urgente. É realiza uma análise aprofundada do marco normativo nacional e comunitário que tutela esses dados, tanto em contexto pré-laboral quanto durante a relação de emprego. São examinadas diversas situações práticas nas quais as novas tecnologias impactam a privacidade dos trabalhadores, desde o processo seletivo até o monitoramento das atividades laborais. Diante desse cenário complexo, a presente dissertação propõe o compliance digital trabalhista como uma ferramenta essencial para garantir um maior equilíbrio entre as partes e assegurar a proteção dos direitos fundamentais dos trabalhadores. Ao analisar a importância de uma mudança cultural nas empresas, o estudo demonstra como a implementação de práticas de compliance pode contribuir para a construção de um ambiente de trabalho mais justo e seguro, no qual os dados pessoais dos trabalhadores sejam tratados com a devida confidencialidade e respeito.
This dissertation traces the historical evolution of labor law from the first industrial revolutions to the present day, highlighting the profound social, economic, and, above all, legal transformations that have occurred throughout this journey. Each new industrial era brought new demands and challenges, requiring constant adaptations of labor law to keep pace with changes and ensure the protection of workers' rights. With the advent of the digital age and the increasing importance of technology in the employment relationship, the protection of workers' personal data has become a central and urgent issue. This dissertation conducts an in-depth analysis of the national and community regulatory framework that governs this data, both in a pre-employment context and during the employment relationship. It examines various practical situations in which new technologies impact workers' privacy, from the recruitment process to the monitoring of work activities. Given this complex scenario, this dissertation proposes digital labor compliance as an essential tool to ensure a greater balance between the parties and guarantee the protection of workers' fundamental rights. By analyzing the importance of a cultural shift within companies, the study demonstrates how the implementation of compliance practices can contribute to the construction of a fairer and safer work environment, where workers' personal data is treated with the due confidentiality and respect.
