Presentemente vivemos um momento histórico em Portugal: pela primeira vez as novas concessões de distribuição de energia elétrica em Baixa Tensão serão atribuídas por concurso público conduzido por municípios/autoridades locais. Tal sucede no contexto da Guerra na Ucrânia, a qual tem vindo a demonstrar-nos o quão vital são as redes de distribuição de energia elétrica enquanto infraestruturas críticas. Os concursos obedecerão à legislação sobre contratação pública em vigor, bem como à legislação específica do setor elétrico, não sendo clara, por enquanto, a necessidade de efetuar mudanças significativas para melhorar ou adaptar alguns aspetos do regime legal às especificidades da distribuição de energia elétrica em BT. A legislação mencionada já incorpora a transposição das Diretivas 2014, relativas à contratação pública. Tanto quanto se pode afirmar, neste momento, as complexidades dos procedimentos legais previstos são esmagadoras, mas têm de permitir atingir os objetivos de garantia de resiliência e segurança das redes de distribuição de energia elétrica, para além do Value for Money. Simultaneamente, surgem dúvidas crescentes, relativas a possíveis inconstitucionalidades da legislação aplicável aos concursos, no que toca à autonomia local, sendo os municípios os responsáveis finais pela aprovação das peças procedimentais, programa de concurso e caderno de encargos, cabendo-lhes também a responsabilidade de adjudicar os contratos de concessão, mediante aplicação do critério de adjudicação. No âmbito da presente dissertação iremos analisar, de uma perspetiva crítica, os desafios colocados pelos concursos em questão.
Presently we live an historical moment in Portugal: for the first time, the concessions for the distribution of low-voltage electricity will be awarded by public tenders, conducted by local authorities. This will happen in the context of the ongoing war in Ukraine, that has shown us just how vital electric distribution grids are as critical infrastructures. The tenders will comply with the public procurement legislation in general, and with specific regulation concerning tenders in the electric system, although it is not clear, yet, if significant changes are needed to refine or adjust some aspects of the legal framework to the specificities of the distribution of low-voltage electricity. The mentioned legislation already incorporates the 2014 Directives, regarding public procurement and public tenders. As far as can be ascertained, at this point in time, the complexities of the legal procedures are staggering, and, simultaneously, the goals of reliability, resiliency and safety of distribution must be met, in addition to the “value for money”. Major concerns also arise, regarding potential non-conformities of the legal framework with the Portuguese Constitution, in what concerns local authorities’ autonomy, as they are responsible for the contest program, the specifications and contractual clauses, also being responsible for the determination of the winning bidder according to the award criteria. In this dissertation we will analyze, from a critical point of view, the challenges posed by these tenders.
