Esta dissertação tem como objetivo principal explorar o protagonismo da diplomacia
brasileira nas Nações Unidas no que tange às discussões sobre cibersegurança e para a
normatização do ciberespaço. A dissertação visa contextualizar o sistema internacional e
refletir sobre os conceitos relativos ao ciberespaço, como cibersegurança e
ciberdiplomacia; identificar as iniciativas nacionais, bilaterais, regionais e multilaterais
na promoção da normatização do ciberespaço; bem como identificar, caracterizar e
exemplificar a atuação do UN GGE e do UN OEWG na promoção de negociações para a
normatização do ciberespaço e de desenvolvimento de medidas de cibersegurança
internacionais. Adicionalmente, a dissertação propõe-se discutir o progresso das
iniciativas internacionais e da diplomacia brasileira no âmbito do ciberespaço e da
cibersegurança. Além disso, destaca o papel desempenhado pelo Brasil nos órgãos das
Nações Unidas para promover a aplicação do direito internacional no ciberespaço,
fazendo uso de soft power como instrumento de influência. Por meio da teoria liberal,
argumenta-se da importância da unificação de terminologias e conceitos relativos ao
ciberespaço para permitir o desenvolvimento pleno de uma normatização internacional
para responsabilizar os Estados por seus comportamentos no ciberespaço. A abordagem
metodológica adotada consiste na complementaridade das formas de raciocínio dedutivo
e indutivo, com a análise de dados qualitativos sendo conduzida sob uma perspectiva
interpretativista. A investigação conclui que o Brasil desempenha um papel de destaque
para a normatização do ciberespaço, evidenciado por sua liderança na presidência de duas
das principais negociações políticas dentro das Nações Unidas e por ser o primeiro país
da América do Sul a divulgar publicamente sua posição sobre a aplicabilidade do direito
internacional no sistema internacional.
The primary objective of this dissertation is to explore the leading role of Brazilian diplomacy in the United Nations regarding the discussion on cybersecurity and the regulation of cyberspace. The dissertation aims to contextualize the international system, reflects on concepts related to cyberspace, such as cybersecurity and cyberdiplomacy, identifies national, bilateral, regional and multilateral initiatives in promoting the regulation of cyberspace, as well as identifying, characterizing and exemplifying the actions of the UN GGE and the UN OEWG in promoting negotiations for the regulation of cyberspace and the development of international cybersecurity measures. Furthermore, the dissertation aims to discuss the development of international initiatives and Brazilian diplomacy in the scope of cyberspace and cybersecurity. It also highlights the role played by Brazil in United Nations bodies to promote the application of international law in cyberspace, using its soft power as an instrument of influence. Through liberal theory, it is argued that the unification of terminology and concepts related to cyberspace is crucial to enable the full development of international norms to hold States responsible for their behavior in cyberspace. The methodological approach employed consists of the complementarity of deductive and inductive reasoning forms, with qualitative data analysis being conducted from an interpretivist perspective. The investigation concludes that Brazil plays a prominent role in the regulation of cyberspace, evidenced by its leadership in two significant political negotiations within the United Nations and its status as the first South American country to publicly disclose its position regarding the applicability of international law in the international system.
