Abstract(s)
O presente trabalho visa analisar os reflexos das mudanças legislativas da previdĂȘncia social brasileira em relação Ă s crises financeiras mundiais e, dessa forma, como isso poderĂĄ gerar desestrutura no seu seio de proteção social. Assim, qual o papel dos direitos fundamentais no Ăąmbito de legitimação ou nĂŁo dessas alteraçÔes. O Estado brasileiro, principalmente apĂłs a Constituição de 1988, adotou um modelo de bem-estar social, com o objetivo de diminuir seu crĂŽnico problema de desigualdade, que foi muito inspirado em paĂses europeus. Entretanto, essa referĂȘncia ao longo dos Ășltimos anos vem sendo alvo de crĂticas em razĂŁo da grande demanda de benefĂcios sociais, o que gera enormes gastos nas contas pĂșblicas. Nesse contexto, como essas mudanças podem comprometer a proteção social instituĂda pela Constituição e se existem limites nessas alteraçÔes para as geraçÔes futuras ou se devem ser direcionadas apenas Ă geração presente. Portanto, trata-se de provocar uma reflexĂŁo sobre o papel de proteção dos direitos fundamentais sociais no que se refere Ă s reformas estruturais na previdĂȘncia social brasileira oriundo da crise financeira internacional. Conclui-se que as reformas no sistema previdenciĂĄrio sĂŁo importantes e necessĂĄrias para o equilĂbrio financeiro e econĂŽmico do paĂs, entretanto, devem sempre observar importantes institutos que influem tanto nas obrigaçÔes, quanto nas polĂticas pĂșblicas, como a Reserva do PossĂvel, o MĂnimo Existencial e ainda a proteção e respeito aos direitos fundamentais.
The present work aims to analyze the reflexes of the legislative changes of the Brazilian social security in relation to the world financial crises and in this way, how this can generate disruption within its social protection, thus, we will study the role of fundamental rights in the context of legitimation or not of these changes. The Brazilian State, mainly after the 1988 Constitution, adopted a model of social welfare, with the objective of reducing its chronic problem of inequality, which was very much inspired by European countries, however, this reference over the last few years has been the subject of criticism. Due to the great demand for social benefits, which generates huge expenditures in public accounts. In this context, I intend to analyze how these changes can compromise the social protection established by the Constitution and if there are limits in these changes for future generations or if they should be directed only to the present generation. Therefore, it is a question of provoking a reflection on the role of protecting fundamental social rights with regard to structural reforms in Brazilian social security arising from the international financial crisis. Institutes that, as reforms in the social security system, are important and significant for the country's financial and economic balance, however, must always observe important institutions that influence both functions and public policies, such as the Reservation of the Possible and also the protection and respect to fundamental rights.
