Abstract(s)
Este estudo contempla a confissão dos fatos como elemento necessário às negociações penais. Após sintética explanação a respeito da justiça penal negociada e seus fundamentos, a investigação aborda características importantes do acordo de não persecução penal. Examinam-se seus fundamentos, assim como discute a natureza jurídica do instituto. Prossegue-se levantando a discussão acerca da constitucionalidade da exigência dessa confissão para celebração do acordo, bem como as consequências probatórias da confissão e sua juridicidade. Em um segundo momento, adentra-se às negociações penais do direito Norte-americano, exploram-se as razões que deram ensejo ao início da utilização do consenso em processos criminais, detalhando as modalidades de negociação atualmente admitidas nos EUA. Revela-se o procedimento adotado segundo normas federais e aborda-se o controle exercido pelo Poder Judiciário. Desenvolve-se, por fim, a discussão sobre a voluntariedade da confissão nas negociações penais.
This study considers the confession of facts as a necessary element in criminal negotiations. After a synthetic explanation regarding negotiated criminal justice and its foundations, the investigation addresses important characteristics of the non-criminal prosecution agreement. Its foundations are examined, as well as the legal nature of the institute is discussed. The discussion continues regarding the constitutionality of requiring this confession to conclude the agreement, as well as the evidentiary consequences of the confession and its legality. In a second moment, the criminal negotiations of North American law are explored, the reasons that gave rise to the beginning of the use of consensus in criminal proceedings are explored, detailing the negotiation modalities currently accepted in the USA. The procedure adopted according to federal standards is revealed and the control exercised by the Judiciary is discussed. Finally, the discussion on the voluntariness of confession in criminal negotiations is developed.
