Abstract(s)
A sociedade está em constante evolução e desenvolvimento. O Direito, lato sensu, deve acompanhar essas mudanças sociais, sempre que possível, para estar na ótica da proteção dos seres humanos. Entretanto, é notório que a sociedade evolui em uma escala muito rápida e muitas vezes, na maioria delas, o Direito não consegue acompanhar tal evolução na época do fato, portanto, regulamenta a posteriori.
Um exemplo disso é o regime da União de Facto (em Portugal) e da União Estável (no Brasil). Hoje, regulamentada em ambos os países, entretanto, há alguns anos, essa união das pessoas que passavam a morar juntos como casal, com a finalidade de constituírem uma família, ainda era vista à margem da sociedade por uma parcela da população. Esta nova modalidade factual ou estável de união familiar, hoje em dia, já se encontra aceita e normatizada pela sociedade e regulamentada pelas normas jurídicas de ambos os países.
A situação de facto entre o casamento e a união de facto é exatamente igual tendo ambas o objetivo de constituir família, ser uma relação pública, duradora e com fins afetivos de natureza familiar.
Entretanto, sob a ótica do direito sucessório português, só há equiparação entre cônjuge e companheiro de facto em alguns direitos pontuais e positivados na Lei da União de Facto. Os unidos de facto não podem ser prejudicados por não escolherem constituir uma família de maneira tradicional e supostamente correta.
No Brasil, essa realidade é diferente. Os cônjuges e companheiros tem direitos equiparados tanto no âmbito do Direito de Família quanto no Direito Sucessório.
Assim sendo, este trabalho visa analisar o Direito do companheiro sobrevivo e do cônjuge sob a luz do regime legal aplicável e a importância da jurisprudência na sua determinação, para que não paire uma discriminação injusta em um momento delicado da vida, a Sucessão.
Society is in constant evolution and development. Law, lato sensu, must keep up with these social changes, whenever possible, to be in the human beings protection point of view. However, it is notorious that society evolves at a very fast scale and many times, mostly, the Law cannot keep up with such evolution at the time of the fact, therefore regulating it subsequently. An example of this is the facto union (in Portugal) and the facto union (in Brazil). Today, regulated in both countries, however, a few years ago, this union of people who started living together as a couple, with the purpose of starting a family, was still excluded of society by a portion of the population. This new factual or stable form of family union, today, is already accepted and regulated by society and regulated by both countries legal standards. The factual situation between marriage and the facto union is exactly the same, both having the objective of constituting a family, being a public relationship, lasting and with affective purposes of a family nature. However, under the Portuguese Inheritance Law, there is equalization between spouses and de facto partners in some specific rights, which are set forth in the facto union Law. The partners in facto union cannot be harmed for not choosing to start a family in the traditional and supposedly correct way. In Brazil, this reality is different. Spouses and partners have equal rights both in Family Law and in Succession Law. Therefore, this work aims to analyze the rights of the surviving partner and spouse in light of the applicable legal regime and the importance of jurisprudence in its determination, so that there is no unfair discrimination in a delicate moment of life, Succession.
