A relação entre o direito e a ética na União Europeia: o status quo da ética e a igualdade inclusiva

No âmbito dos estudos europeus, o direito da União Europeia representa um fator de extrema relevância, assim como a questão da ética, incluindo todos os seus valores e princípios. A relação entre a ética e o direito configura uma temática de estudo complexa e geradora de controvérsia, uma vez que os dois elementos parecem convergir e divergir em simultâneo, consoante a situação em análise, nunca deixando de ser crucial a sua coexistência. Atualmente, a ética tem vindo a tornar-se num tema cada vez mais recorrente, não só através da criação de códigos de conduta e comités de ética, como também pela crescente importância que é dada aos comportamentos éticos e à promoção das boas práticas, tendo este domínio tendência a ganhar cada vez mais destaque em diversas áreas. No entanto, questiona-se até que ponto a ética tem evoluído no campo do direito da União Europeia. Tendo por base os estudos feitos até 2019 sobre o status quo da ética na lei da União Europeia e o levantamento da legislação refente às questões éticas desde então, a presente dissertação teve como objetivo determinar o status quo atual da ética no direito da União Europeia, bem como analisar a sua evolução ao longo deste período. Adicionalmente, e como caso experimental, o presente estudo apresenta ainda uma análise do status quo de um dos princípios éticos normativos constantes no direito da União Europeia - a Igualdade Inclusiva -, de modo a compreender como a União Europeia tem incluído as questões éticas mais específicas na sua legislação.
In the field of European studies, European Union law represents a factor of extreme relevance, as well as the issue of ethics, including all its values and principles. The relationship between ethics and law represents a complex and controversial subject of study, since the two elements seem to converge and diverge simultaneously, depending on the situation under analysis, never ceasing to be crucial their coexistence. Currently, ethics has become an increasingly recurrent theme, not only with the creation of codes of conduct and ethics committees, but also due to the growing importance given to ethical behavior and the promotion of good practices, with this domain tending to gain more and more prominence in several areas. However, it is questioned to what extent ethics has evolved in the field of European Union law. Based on the studies carried out until 2019 on the status quo of ethics in European Union law and the survey of legislation regarding ethical issues since then, this dissertation aims to determine the current status quo of ethics in European Union law, as well as to analyze its evolution over this period. Additionally, as an experimental case, this study also presents an analysis of the status quo of one of the normative ethical principles contained in European Union law - Inclusive Equality - to understand how the European Union has included the most specific ethical issues in its legislation.
