O objetivo do presente estudo é analisar, de forma historicamente contextualizada, a evolução do Ministério Público na França, após a Revolução Francesa de 1789. Nessa perspectiva, busca-se fazer uma análise sobre os primeiros aspectos que possibilitaram a formação das incipientes feições dessa instituição, considerando o citado país como o berço do seu primeiro
arcabouço. Em seguida, empreendeu-se uma linha evolutiva, traçando-se o perfil do Ministério Público em Portugal e no Brasil, distinguindo-se suas principais atribuições e funções. A história da instituição foi analisada à luz do ordenamento constitucional e das leis infraconstitucionais de cada um dos países. Outro objetivo do estudo é dar uma maior visibilidade ao Ministério Público, destacando-o como órgão principal na defesa da legalidade e dos direitos dos cidadãos e detectando, ao mesmo tempo, a evolução de seu
desenvolvimento até os dias atuais. Por fim, empreende-se, uma análise comparada da instituição ministerial em Portugal e no Brasil, no que concerne à impossibilidade de equalização entre a hierarquia funcional, ínsita ao modelo português, e a independência funcional, própria do sistema de garantias estabelecido na Constituição brasileira.
The objective of this study is analyze, in a historical context, the evolution of Department of Justice in France, after the French Revolution of 1789. In this perspective, we seek to make an analyzis about the first aspects that allowed the formation of incipient features of this institution, considering the the mentioned country as the cradle of its first skeleton. Then, embarked an evolution line, tracing the profile of the Department of Justice in Portugal and in Brazil, distinguinshing their main responsabilities and functions. The history of that public institution was analyzed in light of the constitutional system and of the nonconstitutional laws in each countries. Another objective of the study is to give greater visibility to Department of Justice, highlighting it as major public agency in protecting of legality and rights of citizens and detecting, at the same time, the evolution of its development until nowadays. Lastly, takes place a comparative analysis of of the Department of Justice in Portugal and in Brazil concerning the inability of equalization between the functional hierarchy, inherent to the Portuguese model, and the functional independence, own of the system of guarantees established in the Brazilian Constitution.
