Tradicionalmente, la teoria y la dogmatica juridicas apenas se han interesado por la deliberacién legislativa en el parlamento, asi que podria parecer que se trata de un tema poco importante para juristas. Este trabajo pretende, basicamente, corregir esa impresion. Para ello, intento primero mostrar alguna de las implicaciones que el estudio de la argumentacion legislativa puede tener para la teoria del derecho y la dogmatica constitucional. En segundo lugar, sugiero un enfoque para analizar el debate parlamentario de las leyes como fuente de justificacién, y procuro ilustrar con un ejemplo qué tipo de análisis permite hacer. Por ultimo, planteo brevemente el problema de la evaluacion y el control judicial de la deliberacién parlamentaria.
Since neither jurisprudence nor legal dogmatics has traditionally been concerned with legislative deliberation in parliament, it might seem that this topic is of no significance to jurists. This paper's main purpose is to challenge this impression. In the first sections, I set out to show that the study of legislative deliberation has a bearing on current issues in legal theory and constitutional law. Second, I briefly outline an approach to the analysis of parliamentary debates as a source of justification of laws, and give an example of how this approach could work. Finally, I touch upon the problem of the judicial scrutiny of legislative deliberation as a part of the so-called ‘process review’ of legislation.
