O direito portuguĂȘs consagrou um novo paradigma da insolvĂȘncia das pessoas singulares com a introdução do instituto da exoneração do passivo restante. Esta solução pretende conceder uma oportunidade de recomeço econĂłmico ao devedor singular, que apesar de ter pautado a sua conduta por regras de retidĂŁo, honestidade, transparĂȘncia e boa-fĂ©, incorreu numa situação de insolvĂȘncia; mas nĂŁo pode ser vista como um modo normal de desresponsabilização dos seus compromissos financeiros. O legislador pretendeu conjugar de modo inovador o princĂpio fundamental do ressarcimento dos credores com a atribuição aos devedores singulares da possibilidade de se libertarem de algumas das suas dĂvidas e assim lhes permitir a sua reabilitação econĂłmica. O comportamento do devedor Ă© avaliado num primeiro momento de controlo jurisdicional para efeitos de prolação de despacho inicial a determinar o inĂcio do perĂodo de cessĂŁo do rendimento disponĂvel a uma entidade prĂłpria denominada por fiduciĂĄrio. O devedor insolvente deverĂĄ observar determinadas condiçÔes mĂnimas para que o seu pedido possa prosseguir, nomeadamente que nĂŁo se verifique nenhum dos fundamentos de indeferimento liminar do pedido formulado. O devedor ficarĂĄ sujeito ao cumprimento de determinadas obrigaçÔes nomeadamente a cessĂŁo do seu rendimento disponĂvel para efeitos do possĂvel ressarcimento dos credores. O juiz deverĂĄ determinar a exclusĂŁo do montante razoavelmente necessĂĄrio para o sustento mĂnimo do devedor e do seu agregado familiar. A exoneração do passivo restante determina necessariamente algum prejuĂzo pelos credores pelo que terĂĄ que ser um instituto de aplicação ponderada e deverĂĄ se destinar apenas Ă queles devedores que dele se mostram realmente merecedores.
Portuguese law proclaimed a new paradigm of personal bankruptcy with the introduction of the institute of the dismissal of the remaining liability, discharge. This solution aims to provide an economic start over to the singular debtor which, despite having guided his conduct by rules of righteousness, honesty, transparency and good faith, has incurred in a situation of insolvency, but cannot be seen as a normal way of unaccountability of their financial commitments. The law intended to combine, in an innovative way, the fundamental principle of compensation for creditors by giving the singular debtors the possibility to rid themselves of some of their debts, and so they allow their economic rehabilitation. The behavior of the borrower is evaluated at first judicial review for the purpose of delivery of the initial order to determine the start of the leasing period and the disposable income to an entity named fiduciary. The insolvent debtor must comply with certain minimum conditions so that his request can proceed, namely that there is no basis for rejecting the injunction request. The debtor will be subject to certain obligations including the assignment of their disposable income for purposes of possible compensation for creditors. The judge will determine the exclusion amount reasonably necessary for the support of the debtor and household. The dismissal of the remaining liability necessarily determine prejudice to creditors, so this should be a institute of application weighted, and intended only to those debtors that prove to be worthy of.
