Com a elaboração da presente dissertação pretendemos estudar os regimentos dos oficiais régios conforme se encontram estatuídos em dois códigos de leis, respetivamente Las Siete Partidas e as Ordenações Afonsinas. O estudo incidiu sobre os textos de lei que apresentam semelhanças textuais e que se encontram no Título IX da Segunda Partida das Siete Partidas e no Livro I das Ordenações Afonsinas.
Efetivamente as Ordenações Afonsinas partilham um conjunto vasto de semelhanças textuais com as Siete Partidas, atribuídas ao Rei Sábio; estas constituíram uma obra legislativa ímpar da época medieval e da qual ainda podemos encontrar influência na legislação espanhola.
Por forma a introduzir a temática procurámos efetuar uma pequena súmula que transmitisse ao leitor a ideia de que os oficiais sempre foram uma peça essencial nos sistemas burocráticos dos vários povos que habitaram na Península Ibérica após a queda do Império Romano.
Este estudo consiste numa comparação entre os textos de lei anteriormente citados. Verificámos se existem alterações introduzidas no texto das Ordenações Afonsinas que possam significar uma modificação das qualidades e funções desempenhadas pelos oficiais analisados, e procurámos apresentar uma hipótese justificativa quando se verificaram tais modificações, contribuindo, assim, este estudo, na nossa ótica, para uma melhor compreensão das diferentes qualidades, funções, deveres e processos de indigitação dos mesmos, introduzidos na legislação portuguesa.
In this dissertation, we aim to examine legal texts concerning the royal officials’ regulations as found in two legal codes: Las Siete Partidas and the Ordenações Afonsinas. The study focuses on legal provisions that exhibit textual similarities, specifically those in Title IX of the Second Partida of Las Siete Partidas and Book I of the Ordenações Afonsinas. The Ordenações Afonsinas share numerous textual similarities with Las Siete Partidas, attributed to Alfonso X, also known as "the Wise." This latter code is a landmark legislative work from medieval times, whose influence remains visible in Spanish law today. To contextualize the topic, we provide a brief overview to convey the central role that officials played in the bureaucratic apparatus of various peoples inhabiting the Iberian Peninsula after the fall of the Roman Empire. This study involves a comparative analysis of the aforementioned legal texts. We checked whether the Ordenações Afonsinas introduced modifications that altered the roles and attributes of the officials in question, and we propose hypotheses to explain the rationale behind these changes. From our perspective, this study contributes to a deeper understanding of the evolving roles, duties, and appointment processes of officials in Portuguese legislation.
