A inteligĂȘncia artificial definitivamente Ă© parte do nosso cotidiano. Inserida no campo das tecnologias disruptivas, Ă© impossĂvel pensar em inteligĂȘncia artificial sem quebrar paradigmas. O campo do direito de autor, que tem como premissa a inteligĂȘncia e espĂrito humano, experimenta a urgĂȘncia desta proposta artificial que nĂŁo pede licença e veio para ficar. O fato Ă© que robĂŽs, algoritmos e mĂĄquinas tĂȘm gerado, com cada vez mais autonomia, complexidade e aprimoramento, produtos que em muito se assemelham Ă s obras produzidas pelo intelecto humano. Ă neste contexto que surge a problemĂĄtica que orienta esta pesquisa. O objetivo deste estudo Ă© buscar respostas ao principal questionamento neste tocante Ă natureza jusautoral: as obras geradas por inteligĂȘncias artificiais devem gozar de proteção de legal no Ăąmbito do direito de autor? Em caso positivo, quais seriam os caminhos e desafios para a atribuição de tais direitos? Note-se que o que se pretende Ă© trazer para dentro do tradicional escopo jurĂdico do direito de autor, a realidade da inteligĂȘncia artificial, a fim de, por meio dos questionamentos, encontrar uma direção para a problemĂĄtica das obras geradas por inteligĂȘncias artificiais. Para esta anĂĄlise, abordaremos questĂ”es fundamentais sobre a inteligĂȘncia artificial, perpassando pelos tratados internacionais e sob uma visĂŁo geral internacional necessĂĄria e, com foco principal na anĂĄlise universal, nas duas famĂlias jurĂdicas, dos requisitos que fazem de uma obra um objeto passĂvel de proteção pelo direito de autor, Ă luz da tecnologia. De certo, esta Ă© uma estrada de bastantes incertezas, uma vez que ainda hoje hĂĄ poucos trabalhos e endereçamentos especĂficos sobre o tema. Muito com base na ausĂȘncia de uma posição harmĂŽnica e universal sobre um dos grandes desafios deste SĂ©culo XXI, tambĂ©m recorreremos Ă s necessĂĄrias analogias com temĂĄticas preexistentes, bem como nos aventuramos em outras ciĂȘncias inexatas como a filosofia, as artes e a psicologia para tentarmos achar respostas consistentes aos nossos questionamentos.
Artificial intelligence is definitely part of our daily lives. Inserted in the field of disruptive technologies, it is impossible to think of artificial intelligence without breaking paradigms. As per well known, the copyright is the legal science whereby is mandatory the human intelligence and spirit behind it, which now is experiencing the urgency of this artificial proposal that does came to stay. The fact is that robots, algorithms and machines have generated, with increasing autonomy, complexity and improvement characters, works that resemble the artworks produced by the human intellect. This is the context of problem that guides this research work. The objective of this study is to find answers to the main questioning regarding the copyrights nature: the works generated by artificial intelligences should be subject to legal protection into the copyright system? If so, what are the paths and challenges for the addressing of such rights? It must takes place that what is intended herein is to bring within the traditional legal scope of copyright the reality of artificial intelligence, in order to, through the questioning, find a direction for the problematic of the artworks generated by artificial intelligences. For this analysis, we will address fundamental questions about artificial intelligence, passing through international treaties and under the necessary international overview and, with a primary focus on the universal analysis, in the two legal families of the requirements that make a work an object that can be protected by law in the light of technology. Of course, this is a road of considerable uncertainty, since even today there are few specific papers addressing the subject. Based on the absence of a harmonious and universal position on one of the great challenges of this 21st Century, we will also pursue to the necessary analogies with preexisting themes, as well as we will seek into other inaccurate sciences such as philosophy, the arts and psychology to attempt to find answers consistent with our questions.
