O presente trabalho analisa a transformação do direito fundamental da liberdade de expressão, motivada pelo advento e popularização da Internet, e de que forma esta mudança afeta o próprio conceito desse direito e a garantia de outros direitos fundamentais. A grande alteração de conceitos como espaço, tempo e realidade, da comunicação entre os governantes e governados, além de características como a possibilidade de anonimato, resultaram em alterações consideráveis em noções básicas como privacidade, confiança e intimidade, que irão impactar de forma direta conceitos doutrinários relativos às liberdades comunicativas. Por meio de uma estruturação metodológica, a investigação proposta por esta dissertação pretende elucidar alguns conceitos relacionadas com a liberdade de expressão na Internet, especialmente na fase pós-Cambridge Analytica, em que se verifica um crescente processo de desinformação digital que transforma os conceitos de liberdade comunicativas e exige ações combinadas do poder público e do Direito. Conclui-se, após o estudo dos temas supracitados, que conceito de liberdade aplicado à Internet deve ser interpretado de forma ampla, de forma a ser capaz de incluir o acesso de qualidade a esse meio de comunicação e a possibilidade de fazer escolhas dentro da rede, sem possíveis condicionamentos por parte de terceiros. O objetivo dessa nova fase do desenvolvimento da Internet é definir de que forma as plataformas digitais comerciais devem ser responsabilizadas por suas atividades, sem que isso implique o comprometimento do interesse público representado pela Internet. A transparência é o princípio comum da utilização de todas as camadas da web em um período pós-Cambridge Analytica; entretanto, a concretização desse princípio vai além da regulação da Internet porque, inevitavelmente, passa por um processo de capacitação da sociedade, que só pode ser viabilizado por meio de um amplo incentivo a políticas públicas.
This study analyzes the transformation of freedom of speech motivated by the advent and dissemination of the Internet. The significant modification in notions such as space, time, reality, communication between government and citizens, along with the possibility of anonymity, resulted in transformation process of basic perceptions just as privacy, trust and intimacy. Through a methodological structure, the present dissertation intents to elucidate some concepts related to freedom of speech on the Internet, especially in the post-Cambridge Analytica phase, described by a growing process of digital misinformation that requires joint actions of the executive and the law. After the examination of the aforementioned themes, it was concluded that the notion of freedom of speech on the Internet should be interpreted in an extensively mode, in order to be capable to include the access and the opportunity of making choices on the web. The aim of this new stage is to define how digital platforms should be held responsible for their activities, without compromising the public interest represented by the web. Certainly, transparency is the common principle in the post-Cambridge Analytica phase, however, the accomplishment of this principle goes beyond the regulation, because inevitably, it goes through a process of society instruction by means of incentive to public policies.
