O objeto de estudo do presente trabalho está na análise comparativa dos negócios processuais no regime português no regime brasileiro. O direito português tem muito a acrescentar ao Brasil com sua tipificação da possibilidade de as partes convencionarem sobre a instância única, bem como pela possibilidade de interposição do recurso de revista per saltum. Por sua vez, o Brasil está na vanguarda do direito processual, seguindo a onda advinda da Alemanha, tendo adotado, recentemente, cláusula geral autorizativa para os negócios processuais, abrindo brecha à defesa de negócios processuais atípicos sobre recursos. O art. 190 do Código de Processo Civil Brasileiro conferiu às partes o direito de, por meio de negócios processuais, modificarem o procedimento ou convencionarem sobre as suas situações jurídicas processuais – direito, ônus, faculdades, etc. Resta saber os limites para estes negócios processuais que não contam com previsão expressa da lei, de modo que não violem direito fundamentais, analisando os requisitos de existência, validade e eficácia do negócio processual. Inicialmente serão apontadas as noções gerais dos negócios jurídicos processuais, sua origem no direito privado, sua função e importância no direito processual, em especial seus efeitos. Em seguida, serão analisados os limites que possam consubstanciar óbices aos negócios processuais. Por fim, concluiremos com a verificação concreta dos negócios processuais na esfera recursal, em especial as formas típicas da legislação portuguesa em contraposição à sua importação para o sistema recursal brasileiro.
The object of study of the present work is in the comparative analysis of the contracts procedures in the Portuguese regime, and in the Brazilian regime. Portuguese law has much to add to Brazil with its definition of the possibility for the parties to agree on the single instance, as well as for the possibility of bringing the appeal per saltum. On the other hand, Brazil is at the forefront of procedural law, following the wave from Germany, having recently adopted a general authorization clause for contract procedural, opening a hole to the defense of atypical procedural deals on resources. The art. 190 of the Brazilian Code of Civil Procedure conferred on the parties the right, through contract procedural, to modify the procedure or to agree on their legal procedural situations - law, onus, faculty, etc. It remains to know the limits to these procedural deals that do not have an express provision of the law, so that they do not violate fundamental rights, analyzing the requirements of existence, validity and effectiveness of the contract procedural. Initially, the general notions of contract procedural, its origin in private law, its function and importance in procedural law, especially its effects, will be pointed out. Afterwards, the limits that may serve as obstacles to the contract procedural will be analyzed. Finally, we will conclude with the concrete verification of the procedural deals in the appeal, especially the typical forms of the Portuguese legislation as opposed to its importation into the Brazilian appeal system
