| dc.description.abstract | Confrontados com a crescente preocupação do contencioso administrativo em apresentar uma resposta à defesa efetiva, massificada e multifacetada de cada pretensão dos particulares, surge o instituto sob o nomen de extensão dos efeitos das sentenças. Pretendeu-se com a presente dissertação desenvolver o aspeto da natureza jurídica do ato praticado pela Administração. Para o efeito foi realizado um exaustivo estudo sobre o confronto entre a materialidade dos efeitos de uma sentença e a força do caso decidido, o sentido da atuação Administrativa e o juízo judicativo esperado pela atividade jurisdicional. O caminho percorrido sustenta que os limites são ténues, mas que em momento algum se colocou em causa uma sobreposição da função administrativa à função jurisdicional. | por |
| dc.description.abstract | Faced with the growing concern of the administrative litigation to present an effective response to the defense that must be massive and multifaceted of every pretense from individuals, arises the Institute under the nomen of extension of the effects of judgments. With this dissertation, we intend to develop the legal nature of the act committed by the administration. For this purpose, an exhaustive study was carried out of the clash between the materiality of the effects of a judgment and the strength of the case decided, the meaning of Administrative action and the judgment judicative waited for the judicial activity. The way this dissertation was pursued sustains that the limits are tenuous, but that in no time it was questioned an overlap of the administrative function to the judicial function. | eng |
