| dc.description.abstract | A alienação parental não tem sido, em Portugal, peça fundamental no Direito da Família ou das Crianças. No entanto, em muito esta figura deveria relevar, nomeadamente porquanto se afigura necessária a procura por uma resposta prática do Direito que se adeque às várias situações em que é invocada. Infelizmente, depois da separação, em muitas situações a relação dos pais com os filhos acaba por espelhar a relação conjugal conflituosa que outrora existiu. Nesta senda, o interesse da criança é colocado de lado e um dos progenitores começa, gradualmente, a degradar a imagem do outro. Ora, atualmente, não são raros os casos em que é fixada a residência da criança com um dos pais, não obstante o direito a visitas e contactos do outro. Isto faz com que, algumas vezes, o progenitor não residente veja os laços afetivos com o filho ficarem progressivamente mais fracos, podendo mesmo chegar a um ponto de rutura irreversível. Frequentemente, o pai com quem a criança reside habitualmente adota posturas alienantes, incutindo na criança a ideia de que só ele sabe cuidar dela, de que não precisa da outra figura parental e, em casos extremos, acaba por desenvolver a síndrome de alienação parental. Urge, pois, que o Direito esteja preparado para detetar e prevenir, desde o primeiro instante, a exposição de qualquer criança a comportamentos alienantes que prejudicam o seu desenvolvimento e que podem destruir, por completo, os vínculos emocionais que unem o progenitor não residente e o filho. No presente Relatório far-se-á, primeiro, uma exposição breve sobre a problemática e partir-se-á, em seguida, para a análise de um dos casos acompanhados ao longo do estágio. Realizar-se-á ainda uma revisão da jurisprudência existente acerca do tema e, por último, retirar-se-ão conclusões sobre possíveis respostas legislativas, nomeadamente em face do caso concreto apresentado. | pt_PT |
| dc.description.abstract | Parental alienation has not been, in Portugal, a fundamental piece in Family or Children's Law. However, this figure should indeed be more relevant, especially considering the necessity for a practical legal response that adapts to the various situations in which it is invoked. Unfortunately, after separation, in many situations the relationship between parents and children ends up reflecting the conflictual marital relationship that once existed. In this regard, the child's interest is set aside, and one of the parents gradually begins to degrade the image of the other. Currently, it is not uncommon for the child's residence to be established with one parent, notwithstanding the other parent's right to visitation and contact. This sometimes causes the non-residential parent to see their emotional bonds with the child gradually weaken, potentially leading to an irreversible rupture. Often, the parent with whom the child usually resides adopts alienating behaviors, instilling in the child the idea that only he can take care of them, that they don’t need the other parental figure, and in extreme cases, may even develop parental alienation syndrome. It is therefore urgent for the law to be prepared to detect and prevent, from the very beginning, the exposure of any child to alienating behaviors that harm their development and can completely destroy the emotional bonds between the non-residential parent and the child. In this report, a brief exposition of the problem will be made first, followed by an analysis of one of the cases followed throughout the internship. There will also be a review of the existing jurisprudence on the subject, and finally, conclusions will be drawn regarding possible legislative responses, particularly considering the specific case presented. | pt_PT |
