| dc.description.abstract | Os recentes ataques terroristas ocorridos na Europa colocaram em estado de alerta todo o sistema de segurança interna europeu, contribuindo para realçar os sérios desafios que a União enfrenta atualmente no sentido de dar resposta ao flagelo do terrorismo. Em particular, é de salientar a dificuldade em conciliar a segurança com o respeito pelos direitos e liberdades fundamentais, que constitui atualmente uma das grandes preocupações do direito da União Europeia. Um dos dilemas mais complexos que se colocam no âmbito da luta contra o terrorismo é precisamente o de garantir a segurança e assegurar ao mesmo tempo o respeito pelos direitos humanos. A questão da luta contra o terrorismo tem vindo a desencadear reações a nível internacional quanto à necessidade de não permitir que a repressão da ameaça terrorista possa afetar os valores e princípios do Estado de Direito. Por outro lado, mediante o número crescente de ataques terroristas dirigidos contra o mundo ocidental, há quem sustente a necessidade e a legitimidade de se minimizarem as liberdades civis em nome da segurança. Apesar da União Europeia ser um espaço muito privilegiado no palco internacional em termos de proteção e respeito dos direitos do homem e das liberdades fundamentais, a procura de soluções mais eficazes e mais rápidas contra o terrorismo conduziu a limitações dos direitos dos cidadãos em geral, com intuito de dar resposta ao imperativo de segurança, tornando a proteção de certos direitos fundamentais mais precária. Através do presente estudo pretendemos analisar quais são os principais desafios com que a União Europeia se depara atualmente em matéria de proteção dos direitos fundamentais no contexto do combate ao terrorismo e averiguar se perante a ameaça terrorista crescente na Europa será possível a conciliação entre uma repressão eficaz do terrorismo e a proteção dos direitos e liberdades dos indivíduos. | pt_PT |
| dc.description.abstract | The recent terrorist attacks in Europe have put the entire European internal security system on the alert, highlighting the serious challenges the European Union is facing today in response to the scourge of terrorism. In particular, the difficulty of reconciling security with respect for fundamental rights and freedoms is one of the major concerns of European Union law nowadays. One of the most complex dilemmas in the fight against terrorism is precisely to ensure security and at the same time ensure respect for human rights. The issue of the fight against terrorism has been triggering international reactions on the need to not allow the repression of the terrorist threat to affect the values and principles of the rule of law. On the other hand, with the increasing number of terrorist attacks targeting the Western world, there are those who support the need and legitimacy of minimizing civil liberties in the name of security. Although the European Union is a very privileged space on the international stage in terms of protection and respect for human rights and fundamental freedoms, the search for more effective and faster solutions to fight terrorism has led to limitations on the rights of citizens in general, with the aim of meeting the security imperative, making the protection of certain fundamental rights more precarious. The purpose of this study is to analyze the main challenges the European Union is facing in the field of the protection of fundamental rights in the context of the fight against terrorism and to investigate whether in the face of the growing terrorist threat in Europe, it will be possible to reconcile effective repression Terrorism and the protection of the rights and freedoms of individuals. | en |
