O presente trabalho busca elucidar questões referentes aos efeitos da utilização da via arbitral na composição de litígios intra-societários. A solução de tais conflitos pela arbitragem é cada vez mais emergente, principalmente em razão das vantagens que esse meio alternativo de resolução de litígios apresenta. Assim, serão analisadas as questões acerca da arbitrabilidade de litígios, do alcance subjetivo da cláusula compromissória nos estatutos sociais e das questões acerca do contencioso das deliberações sociais, com as possíveis soluções trazidas pela doutrina para que não haja dúvida a respeito da utilização da arbitragem no Direito Societário.
This study aims to clarify some questions regarding to the effects of the use of arbitration in the composition of intra-corporate controversy. The solution of such conflicts through arbitration is constantly increasing, mainly due to the advantages of this kind of alternative dispute resolution. Therefore, the issues about the arbitrability of disputes, the extension of arbitration clause in the bylaws and questions on the corporate resolutions will be analyzed with their possible solutions brought by the doctrine to solve doubts around the use of arbitration in Corporate Law.
