Abstract(s)
O presente trabalho objetiva analisar a arquitetura contemporânea do direito ao esquecimento na sociedade de informação, ou seja, busca identificar os elementos estruturantes do direito ao esquecimento na linha do tempo, desde os primeiros casos envolvendo a mídia analógica até aqueles que envolvem o ambiente digital. A globalização e a tecnologia proporcionaram um demasiado incremento no acesso à informação, nas formas de comunicação e nas modalidades de produção de informação. Tal incremento gerou uma enorme quantidade de produção e de armazenamento de dados e impactou nas fronteiras entre as esferas pública e privada, bem como nos conceitos de memória e de esquecimento. A partir do estudo dos precedentes judiciais, verifica-se que, desde a ambiência analógica do direito ao esquecimento, o direito à privacidade vem sendo utilizado como fundamento para pleitear medidas de concretização do direito ao esquecimento, revelando-se como verdadeiro antecedente histórico deste direito. As medidas para tratamento e eficácia do direito ao esquecimento, desde a sua vertente analógica até a digital, tiveram um importante impulso a partir de casos levados ao judiciário que impactaram fortemente na construção normativa sobre o tema e giram em torno dos pedidos de desindexação, de anonimização, de apagamento e passam pela distinção entre provedor de conteúdo e provedor de pesquisa, como forma de exercício do direito à autodeterminação informativa e do direito ao controle de dados pessoais, bem como reflexo da ponderação entre direitos fundamentais da personalidade e da liberdade de expressão e da informação. Além do estudo das medidas de tratamento e da eficácia do direito ao esquecimento digital, esse estudo se debruça sobre a discussão de sua autonomia e de seus parâmetros, quais sejam: a) Tempo e efeito prospectivo; b) Contexto; c) Conteúdo e d) Titularidade.
This paper aims to analyze the contemporary architecture of the right to be forgotten and it seeks to identify the structuring elements of the right to be forgotten in the timeline, from the first cases involving analog media to those involving the digital environment. Globalization and technology have provided an excessive increase in access to information, in the forms of communication and in the modalities of information production. This increase generated an enormous amount of data production and storage and impacted the boundaries between the public and private spheres, as well as the concepts of memory and forgetting. From the study of judicial precedents, it appears that, since the analogical environment of the right to be forgotten, the right to privacy has been used as a basis for claiming measures to implement the right to be forgotten, revealing itself as a true historical antecedent of this right. Measures for the treatment and effectiveness of the right to be forgotten, from its analogue to the digital aspect, had an important boost from cases brought to the judiciary that had a strong impact on the normative construction on the subject and revolve around the requests for deindexation, of anonymization, erasure and pass through the distinction between content provider and search provider, as a way of exercising the right to informative self-determination and the right to control personal data, as well as a reflection of the balance between fundamental rights of personality and freedom of expression and information. In addition to the study of treatment measures and the effectiveness of the right to digital oblivion, this study focuses on the discussion of its autonomy and its founding elements, namely: a) Time and prospective effect; b) Context; c) Content and d) Ownership.
