O presente trabalho tem como objetivo analisar a natureza jurídica do direito ao esquecimento. Busca, para tanto, identificar sua relação com a dignidade da pessoa humana e com os direitos da personalidade já expressamente consagrados no ordenamento jurídico e que, usualmente, são utilizados como fundamento para o seu reconhecimento. Tem como escopo ainda examinar se é possível compreendê-lo como um direito
autônomo, qual seu conceito mais adequado, sua origem, pressupostos, principais argumentos favoráveis e contrários, bem como diversas decisões judiciais sobre o tema, para, assim, melhor definir o seu âmbito de extensão. Propõe distingui-lo de outras pretensões correlatas e que não raras vezes são utilizadas com a mesma nomenclatura. Por fim, muito embora reconheça a necessidade de avaliação do caso concreto para ponderação entre as liberdades comunicativas e o direito ao esquecimento, defende que, tratando-se de conteúdos relacionados a fatos delituosos, há uma presunção de preponderância de interesse público original e da sua imutabilidade com o decurso do tempo, tendo em vista o relevante caráter preventivo do direito penal, razão pela qual, podem ser reconhecidas, quando for a hipótese, não o direito ao esquecimento, mas sim as pretensões que com ele muitas vezes se confundem e que produzem efeitos menos drásticos à liberdade de expressão e ao direito à informação.
This paper aims to analyze the legal nature of the right to be forgotten. To this end, it seeks to identify its relationship with the dignity of the human person and with the rights of the personality already expressly enshrined in the legal system and which are normally used as a basis for its recognition. Its scope is also to examine whether it is possible to understand as an autonomous law, what is its most appropriate concept, its origin, assumptions, main arguments in favor and against it, as well as various judicial judgments on the subject, so as to better define the its range of extension. It proposes to distinguish it from other related claims and that they are rarely used with the same nomenclature. Finally, even though it recognizes the need to evaluate the specific case for balancing communicative freedoms and the right to be forgotten, defend yourself, dealing with content related to criminal acts, there is a presumption of preponderance of original public interest and its immutability with or over time, in view of the relevant preventive character of criminal law, which is why, when it is a hypothesis, it may be recognized, not the right to be forgotten, but rather as pretensions that are sometimes confused and that produce less drastic effects on freedom of expression and the right to nformation.
