| dc.description.abstract | Este estudo teve como objeto central de análise o consentimento informado, confidencialidade e privacidade no âmbito da relação médico-paciente. O objetivo principal foi aprofundar nossa compreensão desses conceitos essenciais para a prática médica, considerando as implicações éticas e legais envolvidas. Para tanto, partindo dos impactos da evolução das ciências médicas nas ciências jurídicas, procuramos contextualizar a saúde como objeto de direito e, por conseguinte, passível de tutela. Analisando a própria evolução da relação médico-paciente, destacando a prevalência da autonomia deste, foram analisadas questões específicas quanto ao consentimento esclarecido e dever de informação, assim como as questões relativas à confidencialidade e privacidade que norteiam aludida relação, tudo tendo em conta os ordenamentos jurídicos brasileiro e português, culminando o estudo com considerações a respeito da confidencialidade e proteção de dados pessoais, com análise crítica da Lei Geral de Proteção de Dados, no âmbito do ordenamento jurídico brasileiro e o Regulamento Geral de Proteção de Dados no âmbito do direito europeu. Para alcançar esse objetivo, conduzimos uma revisão bibliográfica abrangente, abordando fontes acadêmicas e legais relevantes. Essa análise sistemática permitiu sintetizar as principais contribuições teóricas e jurisprudenciais sobre o tema e ajudou a identificar e analisar as melhores práticas e diretrizes éticas e jurídicas relacionadas ao consentimento informado, sigilo e confidencialidade na relação médico paciente, tudo a contribuir para a eveolução do debate ético e legal a respeito de aludida relação, que tem como objeto o bem jurídico de maior relevância para o ser humano, que é a sua saúde, atributo de sua própria dignidade. | pt_PT |
| dc.description.abstract | This study's central object of analysis was informed consent, confidentiality and privacy within the physician-patient relationship. The main objective was to deepen our understanding of these essential concepts for medical practice, considering the ethical and legal implications involvedThe primary objective was to deepen our understanding of these essential concepts for medical practice, considering the ethical and legal implications involved. To this end, based on the impacts of the evolution of medical sciences on legal sciences, we seek to contextualize health as an object of law and, therefore, subject to protection. Analyzing the evolution of the physician-patient relationship, highlighting the prevalence of the latter's autonomy, specific issues were analyzed regarding informed consent and the duty of information, as well as issues relating to confidentiality and privacy that guide the aforementioned relationship, all taking into account the legal regulations Brazilian and Portuguese legal systems, culminating the study with considerations regarding confidentiality and protection of personal data, with a critical analysis of the General Data Protection Law, within the scope of the Brazilian legal system, and the General Data Protection Regulation within the scope of European law. To achieve this goal, we conducted a comprehensive literature review, addressing relevant academic and legal sources. This systematic analysis allowed us to synthesize the main theoretical and jurisprudential contributions on the subject and helped to identify and analyze the best practices and ethical and legal guidelines related to informed consent, secrecy and confidentiality in the doctor-patient relationship, all contributing to the evolution of the debate ethical and legal regarding the aforementioned relationship, which has as its object the most relevant legal good for human beings, which is their health, an attribute of their own dignity. | pt_PT |
