presente dissertação tem como objetivo desenvolver o atual «estado da arte» da Análise Econômica do Direito de Autor, e desvendar os impactos econômicos que a «pirataria» reverte na criação e fruição de obras artísticas, científicas e literárias. Sabendo-se que o estabelecimento de mecanismos legais de proteção gera tensão entre as dicotômicas posições de incentivo e acesso à criação autoral, busca-se saber em qual medida a manutenção, enrijecimento ou abrandamento do exercício dos direitos de autor é eficiente, através da maior ou menor tolerância com a prática da «pirataria».
This thesis aims to develop the current «state-of-the-art» of the Economic Analysis of Copyright Law, and uncover the economic impacts that «piracy» has on the creation and utilization of artistic, scientific and literary works. Knowing that the establishment of copyright law generates tension between the dichotomous positions of incentive and access to creation of copyrighted works, we seek to discover in what degree the maintenance, stiffening or softening of copyright law is efficient, through greater or less tolerance of «piracy».
