Tem se verificado um aumento significativo da degradação dos solos na União Europeia (UE) e, com base na informação disponível, esta tendência não se inverterá a longo prazo. Apesar de ter sido planeada uma diretiva solo, esta não foi aprovada, e não existe até à data uma legislação específica para os solos da EU. Os diferentes aspetos da proteção dos solos estão dispersos por muitas áreas e integrados em diferentes políticas. Esta dissertação visa contribuir para avaliar o estado da proteção dos solos no âmbito da legislação ambiental da UE, através da identificação e sistematização, num inventário das disposições relevantes em matéria de proteção do solo e da análise das suas características. Verifica-se que as ameaças dos solos não são regulamentadas de forma abrangente pelo legislador europeu e a proteção dos solos parece ser o subproduto de várias disposições que estabelecem principalmente medidas preventivas, qualitativas e não estritamente vinculativas. Este inventário poderá constituir-se como uma base de trabalho e suporte tendente à aprovação num futuro próximo de um quadro de regulamentação próprio, associado à proteção do solo no espaço português e europeu, que tão grande relevância assume para a sustentabilidade do desenvolvimento das nações
There has been a significant increase in land degradation in the European Union (EU) and based on available information, this trend will not be reversed in the long term. Although a solo directive has been planned, it has not been adopted, and there is no specific legislation for EU soils to date. But several aspects of soil protection are scattered across many policy areas. This document helps to assess the state of soil protection under EU environmental legislation by creating an inventory of the relevant provisions and analyzing their characteristics. It appears that soil threats are not comprehensively regulated by European legislature and soil protection appears to be the by-product of several provisions establishing mainly preventive, qualitative, and non-strictly binding measures.
