Este trabalho tem o objetivo de se aprofundar na temática dos refugiados ambientais e em tudo que está a volta dessas pessoas e grupo de pessoas, como a conceituação desse termo – ou a falta dela, o enquadramento e os instrumentos jurídicos existentes nesse sentido, bem como tudo que ainda precisa ser alcançado em termos protetivos, em especial nas matérias de Direitos Humanos. Os refugiados ambientais, além de não serem uma figura juridicamente reconhecida no Direito Internacional, também são extremamente vulneráveis no que tange às alterações climáticas. Este trabalho busca entender quais são as dificuldades conceituais desse termo e como isso poderia ser sanado. Busca, também, fazer uma breve evolução de todos os instrumentos jurídicos referentes aos refugiados ditos “clássicos”, para entendermos como chegamos até aqui e, aí sim, adentrarmos na temática desse “novo” desafio que o Direito Internacional está tendo que lidar mais enfaticamente a cada dia. Essas pessoas ou grupos de pessoas que ultrapassam suas fronteiras por razões climáticas, sejam elas de início súbito ou de início lento, carecem de proteção. Os Direitos Humanos e tudo o que o permeia, trazem algumas garantias para essas pessoas uma vez que estes princípios abrangem todo e qualquer ser humano. Mas ocorre que, garantias e uma proteção mais ampla e direcionada aos refugiados ambientais precisam ser pensadas, tendo em vista que a cada dia, mais situações nesse sentido estão ocorrendo. Este é um problema que vem se intensificando na atualidade, portanto é de imprescindível importância ser debatido juridicamente, bem como no meio acadêmico com mais critério, urgência e seriedade.
This work aims to delve deeper into the theme of environmental refugees and everything that is around these people and groups of people, such as the concept of this term - or the lack of it, the framework and the existing legal instruments in this sense, as well as everything that still needs to be achieved in protective terms, particularly in matters of Human Rights. Environmental refugees, in addition to not being a legally recognized figure in international law, are also extremely vulnerable in terms of climate change. This work seeks to understand what are the conceptual difficulties of this term and how this could be remedied. It also seeks to make a brief evolution of all the legal instruments referring to the so-called “classic” refugees, to understand how we got here and, then, to enter the theme of this “new” challenge that International Law is having to deal more emphatically each day. Those people or groups of people who cross their borders for climatic reasons, whether they are sudden-onset or slow-onset, lack protection. Human Rights and everything that permeates it, bring some guarantees to these people since these principles cover each and every human being. But it turns out that guarantees and a broader protection aimed at environmental refugees need to be thought of, given that every day, more situations in this sense are occurring. This is a problem that has been intensifying today, so it is of vital importance to be debated legally, as well as in the academic environment, with more criteria, urgency and seriousness.
