A República brasileira se apresenta aconfessional e separada da Religião, havendo, ainda, o constituinte positivado a liberdade de crença, como direito fundamental. Dessa conformação institucional decorrem direitos substanciais, dentre eles o de não ser perguntado acerca da religião que professa, mesmo que essa regra não esteja prevista expressamente. A proteção da individualidade é essencial no sistema de proteção da liberdade no Estado Democrático de Direito, que garante o direito da personalidade com vista à formação de uma sociedade plural. A violação do direito de reserva quanto à opção religiosa, principalmente na sede punitiva, evidencia nulidade procedimental ou material do julgado, em decorrência da indevida exposição da convicção religiosa do acusado pela autoridade estatal e torna o processo um auditório secularizado.
The Brazilian Republic presents itself aconfessional and separate from religion, having also the constituent positivised freedom of religion as a fundamental right. From this institutional conformation derive substantial rights, among them not being asked about religion professing, even if this rule is not expressly provided. The protection of the individuality is essential in the protection system of freedom in Democratic State of Law which guarantees the right of personality in order to formation of a pluralistic society. The violation of the right of reservation concerning religious option, particularly in punitive headquarters shows procedural or material nullity of the veredict, due to the undue disclosure of the religious conviction of the accused by state authority and makes the process a secularized public auditorium.
