Derivados da tecnologia denominada Blockchain, os Smart Contracts aportam como sendo uma das aplicações mais promissoras do sistema jurídico contemporâneo. Por ter vasta e facilitada utilidade, bem como por estar inserido em um meio digital o qual não obedece a fronteiras geográficas, advém como uma grande promessa no meio jurídico, econômico e social. Sua aplicação pode ir de a mais simples transação, como ser utilizado de forma massificada no comércio, na compra e venda de ativos, bens ou serviços, e, inclusive, na transmissão de direitos. Por ter natureza disruptiva e ter por característica a sua imutabilidade, uma vez que está inserido em uma plataforma de blocos descentralizada, os Smart Contracts se desenvolvem de forma lenta, gradual e cautelosa. O presente trabalho tem por objetivo entender esta revolução, o qual inclui o
meio em que está inserido e, principalmente, explorar o seu potencial uso e desenvolvimento, abordando as problemáticas que surgem com a sua identificação legal - ou falta dela. Desta forma, imperioso é ressaltar o papel dos profissionais do ramo jurídico na atuação e intervenção desta modalidade contratual que se desenvolve de forma extremamente considerável. Tendo como principal objetivo desta investigação o reconhecimento dos Smart Contracts no sistema legal português, serão abordadas inúmeras aplicabilidades
cotidianas destes, tendo foco, também, em sua formação e características singulares que se destacam na esfera contratual, em especial quando realizamos uma comparação com a forma clássica de contratação.
A fim de materializar tais questões, baseamo-nos na revisão doutrinária, assim como na análise da legislação vigente - tanto a nível europeu, quanto português - procedendo com o entendimento desta nova relação jurídica e seus desafios emergentes.
Derived from the technology called Blockchain, Smart Contracts emerge as one of the most promising applications of contemporary legal systems. Due to their vast and facilitated utility, as well as being embedded in a digital environment that knows no geographic boundaries, they arise as a significant promise in legal, economic, and social realms. Their application ranges from the simplest transaction to mass adoption in commerce, asset trading, goods, or services, and even in the transfer of rights. Due to their disruptive nature and characteristic immutability, as they are embedded in a decentralized block platform, Smart Contracts develop slowly, gradually, and cautiously. This study aims to understand this revolution, including the environment in which it operates, and primarily explore its potential use and development, addressing the issues that arise with its legal identification - or lack thereof. Thus, it is imperative to highlight the role of legal professionals in the application and intervention of this contractual modality, which is developing significantly. With the main objective of this investigation being the recognition of Smart Contracts in the Portuguese legal system, numerous everyday applications of these will be addressed, focusing also on their formation and unique characteristics that stand out in the contractual sphere, especially when compared to the classical form of contracting. In order to materialize such issues, we rely on doctrinal review as well as analysis of current legislation - both at the European and Portuguese levels - to understand this new legal relationship and its emerging challenges.
