A presente dissertação retrata a problemática da regulação no mercado do sector da saúde, procurando identificar as suas fragilidades e deficiências ao mesmo tempo que tenta evidenciar o papel da entidade Reguladora na prevenção, correção e punição de tais falhas de mercado.
Discutimos a questão terminológica da Entidade Reguladora da Saúde (ERS), tendo em conta a diversidade de formas de designação, tendo-se concluído não haver consenso generalizado.
A Entidade Reguladora da Saúde assume uma importante responsabilidade na prossecução do objetivo de obtenção de serviços de saúde de melhor qualidade ao preço mais justo e uma concorrência leal, contando com um conjunto alargado de competências designadamente regulação, supervisão, fiscalização e sanção.
A atividade da Entidade Reguladora da Saúde na defesa dos interesses dos utentes, tem necessariamente de ser acompanhada de independência, algo que lhe confere um traço distintivo de outras formas de regulação e maior margem na sua atuação, com efeito analisamos a sua independência funcional, orgânica e técnica. No entanto, esta independência possui certas limitações que procuramos abordar ao longo do nosso trabalho, além da problemática da legitimidade dos membros da Entidade em apreço.
Procuramos analisar, ainda que de forma genérica a regulação na União europeia, que é exercida de forma subsidiária em relação aos estados membros, bem como fizemos uma referência aos instrumentos comunitários na saúde.
This work depicts the problem of regulation in the health sector of the market, seeking to identify their weaknesses and shortcomings at the same time trying to highlight the role of the Regulatory Authority in the prevention, correction and punishment of such market failures. We discussed the issue of terminological Regulatory Authority of Health, taking into account the diversity of forms of designation, it was concluded that there is no general consensus. The Regulatory Authority of Health assumes an important responsibility in the pursuit of the goal of obtaining better quality health services at the right price and fair competition, with a wide range of skills including regulation, supervision, inspection and sanction. The activity of the Regulatory Authority of Health in defense the interests of users, must necessarily be accompanied by independence, something that gives it a distinctive feature of other forms of regulation and higher margins in its operations, with effect we analyze its functional independence, organic and technical. However, this independence has certain limitations which seek to address through our work, beyond the issue of the legitimacy of authority members in question. We tried to analyze, although generically regulation in the European Union, which is carried on a subsidiary basis in relation to the member states and made a reference to the Community instruments on health.
