Este estudo, que versa sobre os privilégios e imunidades das Organizações Internacionais descreve a evolução quer das Organizações Internacionais, quer dos seus privilégios e imunidades. Um dos objectivos deste estudo foi o de distinguir as Organizações Internacionais de outros sujeitos jurídicos internacionais, especialmente dos Estados, e ainda distinguir os seus privilégios e imunidades, dos privilégios e imunidades diplomáticos e soberanos. O segundo objectivo foi o de fundamentar os mesmos na sua necessidade funcional, admitindo‐se, portanto, na existência de vários regimes costumeiros internacionais como fonte de Direito, consoante, pelo menos, duas categorias de Organizações Internacionais. Recentemente, tem‐se discutido a relação entre os seus privilégios e imunidades e a violação dos Direitos Humanos, e como tal, o estudo também abrangeu essa problemática. Por fim, o último objectivo foi o de descrever e de sistematizar cada privilégio e imunidade em particular. O método escolhido foi o estudo de: bibliografia, convenções internacionais, jurisprudência internacional e estatal, e outros documentos oficiais.
This study, which deals with the privileges and immunities of International Organizations describes the evolution of both International Organizations and their privileges and immunities. One of the objectives of this study was to distinguish the International Organizations from other international legal entities, especially from States, and also distinguish their privileges and immunities, from the diplomatic and sovereign ones. Another objective was to justify them in their functional need, assuming therefore, the existence of several customary international regimes as a source of Law, for at least two categories of International Organizations. The relationship between the privileges and immunities and the violation of Human Rights has recently been discussed, and as such, this study also covered this. Finally, the last objective was to describe and to systematize every privilege and immunity in particular. The method chosen was the study of: literature, international conventions, case law (international and domestic) and other official documents.
