Abstract(s)
A presente investigação tem por escopo a análise do Direito impactado pelos fenômenos advindos da utilização de mecanismos tecnológicos e da realidade virtualizada. A primeira parte está sedimentada em questões conceituais e estruturais afetas ao Direito e à Internet, para que seja possível a compreensão, em profundidade, dos mecanismos que moldaram a sociedade cibernética. Além disso, tratou-se da temática afeta ao Big Data, da prática do Direito Digital como disciplina jurídica e das imperfeições regulatórias da internet. A segunda parte aborda, especificamente, a nova realidade enfrentada pelo Direito, marcada pelos aspectos decorrentes da construção das redes sociais virtuais e dos reflexos no campo da privacidade. Igualmente é verificada a ideia de verdade no mundo cibernético e o caminho da desinformação, sem se olvidar do tratamento dado ao direito ao esquecimento, ao tratamento jurídico post mortem do conteúdo inserido no mundo virtual e a utilização de mecanismos preditivos, a exemplo da jurimetria. Nesta parte da dissertação procuramos identificar alguns institutos jurídicos impactados pelas novas tecnologias informáticas, os quais foram utilizados como premissas para a estruturação do paradigma jurídico-cibernético. Na terceira parte tratamos da interconexão do Direito com a Inteligência Artificial, tão presente no cotidiano daqueles que habitam quase todas as regiões do Planeta. Apresentamos traços estruturais da Inteligência Artificial e as correspondentes potencialidades. Analisamos as relações algorítmicas e a natureza das máquinas. Diagnosticamos a responsabilidade dos criadores e utilizadores de sistemas inteligentes, as diretrizes éticas para uma Inteligência Artificial confiável e a imperiosa necessidade de regulação, seja pela via estatal ou privada. Analisamos, por conseguinte, a responsabilidade por danos decorrentes da utilização de sistemas autônomos e semiautônomos, com a abordagem de questões afetas a veículos inteligentes. Por fim, tratamos da possibilidade de julgamentos promovidos por juízes-robôs, concluindo que a ideia de uma justiça sob a responsabilidade de máquinas é flagrante violação à dignidade humana. Realçamos, ao longo da investigação, que o Direito resulta de criação humana e que máquinas devem servir apenas como instrumentos que tornem a vida e o mundo mais valiosos e humanamente justos.
The scope of this investigation is the analysis of Law impacted by the phenomena arising from the use of technological mechanisms and virtualized reality. The first part is based on conceptual and structural issues related to Law and the Internet, so that it is possible to understand, in depth, the mechanisms that have shaped the cybernetic society. In addition, it dealt with the theme related to Big Data, the practice of Digital Law as a legal discipline and the regulatory imperfections of the internet. The second part specifically addresses the new reality faced by the Law, marked by the aspects arising from the construction of virtual social networks and the reflections in the field of privacy. The idea of truth in the cyber world and the path of disinformation are also verified, without forgetting the treatment given to the right to be forgotten, the post-mortem legal treatment of content inserted in the virtual world and the use of predictive mechanisms, such as jurimetrics. In this part of the dissertation we seek to identify some legal institutes impacted by new computer technologies, which were used as premises for the structuring of the legal-cybernetic paradigm. In the third part, we deal with the interconnection of Law with Artificial Intelligence, so present in the daily lives of those who inhabit almost all regions of the Planet. We present structural traits of Artificial Intelligence and the corresponding potentialities. We analyze algorithmic relationships and the nature of machines. We diagnose the responsibility of the creators and users of intelligent systems, the ethical guidelines for reliable Artificial Intelligence and the imperative need for regulation, whether by state or private means. We therefore analyze the liability for damages arising from the use of autonomous and semi-autonomous systems, with the Finally, we deal with the possibility of trials promoted by robot judges, concluding that the idea of justice under the responsibility of machines is a flagrant violation of human dignity. Throughout the research, we emphasize that Law is the result of human creation and that machines should only serve as instruments that make life and the world more valuable and humanly just.
