Considerando que o Brasil se debate em violência e marcante diferença social, e que esta não encontra qualquer proposta do “Estado morto” ,o tema tem o mote de desnudar a falácia de legalidade constitucional. Intentamos identificar quais os limites reais que, sob o liberalismo histórico, catapultaram a Constituição ao patamar de corolário legal, erga omnes, e no presente, sob a batuta político-econômico neoliberal, fazem dela uma verdadeira “letra morta”. Por seu turno, a investigação se justifica pois, dizer da Constituição em um prisma de sua dialeticidade histórica mostra-se hoje, no ápice do capitalismo neoliberal, mais que uma crítica do sistema, mas um verdadeiro compromisso com a verdade coletiva que até então tem sido esmagada pela razão individual. No campo da problematização, o tema atende à expectiva de elucidação de seus objetivos, vale dizer, tratar da Constituição como instância jurídica respondente ao interesse da elite econômica burguesa, e para tal nos serviremos de algumas indagações que, mergulhadas na discussão, nos proporão um melhor dissecamento para compreensão do tema. Partindo da premissa que se atribui ao sistema capitalista a fonte das desigualdades e opressão que abatem o mundo contemporâneo, e que sua superação restringe-se exclusivamente a uma ação desalienadora/revolucionária do homem frente à sua realidade de exploração, será aqui o direito – em particular a Constituição – compreendido sob o ponto de vista do materialismo dialético, investigado em uma perspectiva de instância ideológica da infra-estrutura econômica capitalista e, ipso facto, orientado como instrumental de sua super-estrutura política. Conhecer a Constituição através da metodologia dialético-materialista, é pretender verificar, na investigação, algumas hipóteses que o método impõe: a Constituição corresponde a um documento jurídico de utilização ideológica do sistema capitalista; no liberalismo clássico, o discurso da igualdade foi condutor de concretude dos direitos individuais-burgueses da propriedade e da liberdade de contratar; o capitalismo para ser consolidado, reclamou uma Constituição como norma maior legitimadora daqueles princípios ditos democráticos; que, finalmente, a Constituição, no hodierno estágio das forças produtivas, traduzido pelo capitalismo monopolista globalizado, perdeu seu papel de vanguarda normativa face ao princípio da não-intervenção estatal na economia regente e inerenteàquela fase monopolista, que por sua vez subverte qualquer proposta - das mais avançadas para o capitalismo – de Estado Social – mínimo em sua inteireza - porquanto o sistema prescinda absolutamente de legalidade interna, exigindo mesmo uma robusta e incontestável desconstitucionalização política, cujas normas, agora supranacionais, restrinjam-se aos ditames do mercado.
Whereas Brazil struggles in violence and striking social difference, and that this proposal does not meet any of the "dead state", the theme has the motto of stripping the constitutional legality fallacy. We try to identify what are the real limits that, under the historical liberalism, catapulted the Constitution to the level of legal corollary, erga omnes, and on the present, under the neoliberal political-economic direction, make of it a true “dead letter”. For its part, the research is justified as, taking the Constitution in a prism of its historical dialeticity is shown to be today, at the apex of neoliberal capitalism, more than a critique to the system, but a real commitment to collective truth that has so far been overwhelmed by individual reason. In the field of problematizing, the theme caters the expectation of clarifying its objectives, that is, treating the Constitution as respondent juridical instance to the bourgeois elite economic interests, and for such we use some questions that, dipped in the discussion, will propose us a better dissecting for the theme’s understanding. Assuming that the capitalist system is attributed to be the source of the inequalities and oppression that slaughter the contemporary world, and that its overcoming it is exclusively limited to a men disalienating/revolutionary action towards their exploitation reality, Law will be here – and the Constitution, in particular - understood from the point of view of dialectical materialism, investigated through a perspective of ideological instance of capitalism economical infrastructure and, ipso facto, oriented as instrumental of its political superstructure. To get to know the Constitution through the dialectical-materialist methodology, is to intend to verify, on the investigation, some hypotheses that the method itself imposes: the Constitution corresponds to a legal document of ideological use by the capitalist system; within classical liberalism, the equality discourse was conductor of the concreteness of bourgeois-individual rights of property and freedom of contract; capitalism to be consolidated, claimed a Constitution as a higher standard norm legitimating of those principles said to be democratic; that, finally, the Constitution in today's stage of the productive forces, translated as the globalized monopoly capitalism, has lost its vanguard normative role in the face of the principle of state non-intervention in the ruling and inherent to that monopolistic phase economy, which in turn subverts any welfare state – minimun in its entireity – proposal – even the most advanced for capitalism – so far the system dispenses absolutely internal legality, demanding a robust and indisputable political deconstitutionalization, whose norms, now supranational, have to be restricted to the market rulings.
