Pautada pela busca de solidificação e expansão por toda a ordem mundial a FIFA desde os seus primórdios se utiliza de regulamentos que são obrigatoriamente extendidos para todos os seus associados. A FIFA regula a participação de terceiros nos Direitos Econômicos do atleta de futebol de forma proibitiva - artigos 18Bis e 18Ter criados em seu Regulamento de Transferência de atletas - sob alegação de que esta atuação pode influenciar negativamente o jogo. A aplicação dos artigos causa conflitos com as normas gerais de Direito. Analisando em pormenores fica evidente que a medida proibitiva não possui fundamentos válidos e sua aplicação é violadora dos direitos de seus associados e dos terceiros investidores face à Livre Concorrência. A medida ratifica a desigualdade e coloca o futebol à margem do Direito estatal. Por essa razão, a normativa é um retrocesso à luz da Livre Concorrência e, se os objetivos reais da FIFA fossem de proteger o jogo, medidas de controle da atuação dos terceiros investidores seriam criadas e, não, a sua proibição total.
Guided by the search for solidification and expansion throughout the world order, FIFA has used regulations since its inception that are obligatorily extended to all its members. FIFA regulates the participation of third parties in the economic rights of the soccer athlete in a prohibitive way articles 18Bis and 18Ter created in its Regulation of Transfer of Athletes - under the allegation that this performance may negatively influence the game. The application of the articles causes conflicts with the general rules of law. Analyzing in detail, it is evident that the prohibitive measure has no valid basis and its application violates the rights of its members and third investors in the face of Free Competition. The measure ratifies inequality and puts football on the margins of state law. For this reason, the rules are a step backwards in the light of Free Competition and, if the real objectives of FIFA were to protect the game, measures to control the actions of third investors would be created and not their total ban.
