A presente dissertação de mestrado pretende estudar a forma como a Convenção Europeia dos Direitos Humanos protegeu os direitos humanos, perante e recente crise económica e as medidas de austeridade.
De forma introdutória é feita uma contextualização da crise económica e da austeridade, e são apresentados os principais instrumentos desenvolvidos pelas Nações Unidas sobre este tema.
Foi estudado o artigo 1º do protocolo 1, que prevê o direito de propriedade, feita uma análise da jurisprudência do Tribunal Europeu dos Direitos Humanos em casos em que foram impostas medidas de austeridade, por programas de assistência económica internacional, e feito um comentário a estas decisões.
Refere-se o contributo do Comissário dos Direitos Humanos e da Assembleia Parlamentar com vista a contextualizar o impacto que as medidas de austeridade tiveram nos direitos humanos na Europa.
Concluiu-se que o Tribunal reconheceu uma especial margem de apreciação aos Estados, atendendo à situação economia vivida.
The present masters dissertation looks at the way in which the European Convention of Human Rights protected human rights, when faced with the recent economic crisis and austerity measures. As an introductory note, there is a reference to the economic crisis and austerity, followed by an analysis of the main instruments developed by the United Nations on this issue. An overview of article 1º of protocol 1, which establishes the protection of property, is done, followed by an analysis of the European Court of Human Right’s jurisprudence in cases where austerity measures were applied under international economic assistance programs, followed by a commentary. A reference is made to the contribution of the European Commissioner for Human Rights and the Parliamentary Assembly in understanding the impact that the austerity measures had in the human rights protection in Europe. In conclusion, the Court considered that there was no violation of the article, and referred to the country’s margin of appreciation due to its exceptional economic situation.
