A Constituição brasileira de 1988, formada em um momento revolucionário de grandes aspirações democráticas, trouxe em seu texto um amplo rol de direitos sociais. As promessas eram muitas. No entanto, o que vemos atualmente é uma nova crise econômica e política a colocar em dúvida a possibilidade de realização desses direitos. O desequilíbrio econômico aumenta a escassez e pressiona governos de âmbito local e federal à adoção de medidas de austeridade que imponham sacrifícios sociais. Diante deste cenário é que se questiona a legitimidade destas medidas e o papel que juízes constitucionais assumem perante Governo e sociedade. Assim, através de estudo da doutrina jurídica e da jurisprudência de Brasil e de Portugal, a regra da ponderação é apresentada como um instrumento a serviço dos juízes que enfrentam a difícil tarefa de julgar interesses econômicos e sociais em tempos de crise.
The Brazilian Constitution of 1988, formed in a revolutionary moment of great democratic aspirations, brought in its text a wide roll of social rights. The promises were many. However, what we are seeing today is a new economic and political crisis that calls into question the possibility of realizing these rights. The economic imbalance increases scarcity and puts pressure on local and federal governments to adopt austerity measures that impose social sacrifices. In this scenario the legitimacy of these measures and the role that constitutional judges assume before Government and society is put into question. Thus, through the study of legal doctrine and of the jurisprudence of Brazil and Portugal, the rule of balancing is presented as an instrument in the service of judges that face the difficult task of judging economic and social interests in times of crisis.
