O presente estudo visa contribuir para a compreensão do regime e admissibilidade aplicável na utilização da garantia do penhor de crédito futuro para a satisfação do credor em caso de incumprimento da obrigação pelo devedor, quando este não possuir no momento da assinatura do contrato bens disponíveis em sua esfera patrimonial para dar em garantia. Para esse efeito, o estudo analisa os fundamentos de admissibilidade do penhor de créditos futuros, o conceito de “créditos futuros”, a relação entre o nascimento do crédito e a perfeição do contrato do penhor e o papel desempenhado pela notificação do devedor. Portanto, é analisada a admissibilidade dessa forma de garantia frente alguns ordenamentos jurídicos, como o português, espanhol, italiano e brasileiro.
The present work wants to contribute to understand the regime and admissibility applicable in use the pledge of futures receivables to the creditor satisfaction in case of breach of the obligation by the debtor, when the debtor doesn´t have at the time of signing the contract assets available in his patrimonial sphere to give in guarantee. For this purpose, the study focuses on the grounds of admissibility of the pledge of future receivables, the concept of “future receivables”, the relationship between the creation of the receivable and the perfection of the pledge and the relevance of the notification to the debtor. Therefore, the admissibility of this type of guarantee is analyzed in some legal systems, such as Portuguese, Spanish, Italian and Brazilian.
