Estado regulador e telecomunicações: o Brasil sob uma perspectiva portuguesa

Aborda-se a atuação do Estado Regulador no âmbito do setor econômico das telecomunicações. Parte-se de contextualização histórica e conceitos iniciais da atuação regulatória estatal no mundo. Aborda-se a legitimidade do Estado Regulador, tratando das falhas de mercado relativas a monopólio e poder de mercado, externalidades, bens coletivos e assimetrias de informações. Trata-se das teorias da regulação a partir da análise das escolas regulatórias norte americana e francesa, enfatizando-se sobre a aplicabilidade da teoria da regulação responsiva no contexto regulatório brasileiro. Analisa-se as entidades reguladoras no Brasil e em Portugal, por meio de exposição de fontes normativas e fundamentos, modalidades e regime jurídico especial. Faz-se estudo amplo sobre as entidades reguladoras das telecomunicações em Portugal (Anacom), no Brasil (Anatel) e em outros países (Alemanha, Austrália, Estados Unidos, Índia, Malásia e Reino Unido). Realiza-se detalhamento sobre o emprego da terminologia setorial nos arranjos institucionais português e brasileiro. Explora-se a influência da União Europeia na liberalização do setor de telecomunicações português, bem como diversas diretivas que regulamentam o tema em âmbito comunitário. Avalia-se a alteração do marco jurídico-regulatório das telecomunicações do Brasil, promovida pela Lei n.º 13.879, de 2019, analisando-se a possibilidade de fim antecipado das concessões do STFC, prestado em regime público no Brasil, a perda de relevância da telefonia fixa pelo advento da mobilidade das comunicações e da Internet, as implicações da alteração de paradigma, principais vertentes oriundas da mudança para o regime privado de prestação, bem como as dificuldades na implementação do serviço universal de Portugal. Aborda-se os impactos iniciais da pandemia de covid-19 no setor de telecomunicações em Portugal, no Brasil e outras partes do mundo, além das principais medidas adotadas em resposta e as perspectivas para o período pós-pandemia, acerca do qual tem-se como vetor essencial a transformação digital.
We take the role of the Regulatory State within the scope of the economic sector of telecommunications. It starts with historical contextualization and initial concepts of state regulatory action in the world. The legitimacy of the Regulatory State is addressed, dealing with market failures related to monopoly and market power, externalities, collective goods and information asymmetries. We treat about the theories of regulation from the analysis of the North American and French regulatory schools, emphasizing the applicability of the theory of responsive regulation in the Brazilian regulatory context. Regulatory entities in Brazil and Portugal are analyzed, through exposure of normative sources and fundamentals, modalities and special legal regime. A broad study is carried out on the regulatory entities of telecommunications in Portugal (Anacom), in Brazil (Anatel) and in other countries (Germany, Australia, United States, India, Malaysia and the United Kingdom). Details are given on the use of terminology sectoral in Portuguese and Brazilian institutional arrangements. The influence of the European Union in the liberalization of the Portuguese telecommunications sector is explored, as well as directives that regulate the theme at the community level. The alteration of the legal-regulatory framework for telecommunications in Brazil, promoted by Law n.º 13,879, of 2019, is evaluated, analyzing the possibility of early termination of concessions of the switched fixed telephone service, provided under public regime in Brazil, caused by the loss of relevance of fixed telephony due to the advent of mobility of communications and the Internet, the implications of the paradigm shift, main aspects arising from the change to the private provision regime, as well as the difficulties in implementing the universal service in Portugal. It addresses the initial impacts of the covid-19 pandemic in the telecommunications sector in Portugal, Brazil and other parts of the world, in addition to the main measures adopted in response and the prospects for the post-pandemic period, about which digital transformation is an essential vector.
