No contexto das consequentes crises econômicas, a sociedade se viu obrigada a criar importantes mecanismos de combate face à recessão. Tais mecanismos se conectam em diversas áreas, como no caso da flexibilização no Direito do Trabalho, trazendo uma nova realidade. Surge o teletrabalho como ferramenta flexibilização das regras tradicionais do trabalho, no que diz respeito primordialmente ao local da prestação do serviço e a utilização de tecnologias da informação e comunicação (TIC). A tecnologia fez com que surgissem novas fronteiras que vieram para transformar o mundo, representando marco importante, com grandes reflexos práticos na relação de trabalho e na sociedade, positivos e negativos. De fato, as normas laborais baseiam-se na necessidade de proteção do trabalhador, da dignidade, segurança e sua saúde, ao que esta nova forma de trabalhar colocou diversas questões em pauta, com a necessidade de reflexão do que se achava ser inalterável, nomeadamente no que diz respeito à concepção de que o trabalhador sempre estaria sujeito a um contrato típico de trabalho, a ser desempenhado em local fixo de seu empregadore adstrito às regras tradicionais de prestação do trabalho. Perante a nova realidade, o Direito do Trabalho se viu obrigado a se atualizar e regulamentar contratos atípicos de trabalho, ao passo que as entidades empresariais necessitaram se reestruturar por forma a se manterem vivas no mercado.
In the context of the ensuing economic crises, society was forced to create important mechanisms to combat the recession. These mechanisms are connected in several areas, as in the case of flexibilization in the Labor Law, bringing a new reality. Teleworking emerges as a tool to make the traditional rules of work more flexible, with respect to the place of service provision and the use of information and communication technologies (ICTs). Technology has given rise to new frontiers that have come to transform the world, representing important milestone, with great practical reflexes in the working relationship and in society, positive and negative. In fact, labor standards are based on the need for worker protection, dignity, safety and health, to which this new way of working has put several issues on the agenda, with the need to reflect on what was believed to be unchangeable, namely with regard to the conception that the worker would always be subject to a typical work contract, to be performed in a fixed place of his employer and attached to the traditional rules of work provision. Given the new reality, labor law was forced to update and regulate atypical contracts of work, while the business entities needed to be restructured in order to stay alive in the market.
