A economia do século XXI é cada vez mais digital, com dados pessoais sendo um dos ativos mais relevantes do nosso tempo. Neste estudo, investigamos o Digital Markets Act (DMA) e a sua interação com o Regulamento Geral de Proteção de Dados (RGPD), quais os “trade-offs” desafiam os objetivos de disputabilidade e equidade do DMA. Analisamos como a “Web” em evolução pode impactar a busca pelo equilíbrio entre concorrência e proteção de dados no cenário de descentralização da informação. Por fim, a pesquisa explora as implicações da tecnologia que emerge com a “Web 3.0” e examina o papel dos contratos inteligentes e da blockchain na transformação dos mercados digitais e na promoção de uma concorrência e privacidade.
The 21st-century economy is becoming increasingly digital, with personal data emerging as one of the most significant assets of our era. In this study, we delve into the Digital Markets Act (DMA) and its interplay with the General Data Protection Regulation (GDPR), examining the trade-offs that challenge the DMA's objectives of contestability and fairness. We analyze how the evolving "Web" might influence the pursuit of a balance between competition and data protection in a decentralized information landscape. Lastly, the research explores the implications of the emerging technology associated with "Web 3.0" and assesses the role of smart contracts and blockchain in reshaping digital markets, promoting both fair competition and privacy.
