| dc.description.abstract | Observando-se a expansão do Direito Penal Internacional para o reconhecimento da jurisdição do TPI para julgar crimes ambientais nem sempre coerentes com o Estatuto de Roma e, reconhecendo que, para se consolidar, será preciso que este novo ramo do Direito ultrapasse uma série de problemas de compatibilização entre os Direitos Penal e Ambiental Internacionais, a presente Dissertação de Mestrado teve por objetivo: analisar as novas propostas de criminalização ambiental internacional que se apresentam e os seus efeitos diante da sistemática daquilo que poderíamos chamar de microssistema de Direito Penal Internacional do Ambiente, buscando, de tal forma: I) sistematizar com base nas fontes normativas aplicáveis à matéria (em especial, os princípios, jurisprudência e costumes internacionais) um modelo mínimo a ser observado como base dogmática desse sistema; II) no qual foram confrontadas estas propostas, no sentido de se verificar se há uma harmonização entre os anseios punitivistas ambientais e as garantias do acusado em um sistema que se pretende privativo de liberdade; III) Para tanto, utilizou-se de casos concretos como elemento de fundo para uma melhor elucidação das questões dogmáticas presentes nesse contexto, fazendo-se, desde já, uma distinção entre os mecanismos de proteção do ambiente de per se (enquanto objeto de tutela), daqueles que visam a proteção de outros bens que não o ambiente, mas acaba por protegê-lo por via reflexa (proteção por ricochete). | por |
| dc.description.abstract | The lack of efficiency of the International Environmental Law for the resolution of sensitive problems of the global community within the context of risk society, especially by the awareness about the exhaustibility of natural resources and the potential of a cataclysm caused by human action (v.g global warming; nuclear war; conflicts due to the scarcity of resources), has stimulated movements focused on the search for stricter international regulation. As an answer for this demand, the expansion of Criminal Law (by the creation of an International Environmental Criminal system) is being pointed as an immediate solution to the issue. For the consolidation of these propositions, this new legal framework will need to overcome a range of difficulties with the compatibility between International Environmental and Criminal Laws. This research draws on this question by the confrontation of these environmentalist propositions with the systematic of the general part of the International Criminal Law as a way to contribute to a future dogmatic development of this new field in construction. Therefore, the research will be divided into three stages: First, it will seek to present a systematic overview of the general principles codified and recognized by the international criminal jurisprudence to, by the definition of the object present in the proposals of the Ecocide and IAES, make an analytical interpretation of these propositions as to their suitability with such systematic and thus conclude about what might or might not be recognized as such and which elements will need to be developed for a better systematic adjustment between the environmental desires and the guaranties of the accused in a criminal system. | en |
