| dc.description.abstract | A figura das empresas locais no geral, e em particular das empresas municipais, tem vindo a ganhar cada vez mais relevância com o passar dos anos. Estas empresas são uma extensão das entidades públicas participantes as quais compõem a administração pública. Percebemos então que a temática da insolvência ao abranger estas empresas levanta questões sobre a coerência do ordenamento jurídico português, a segurança e a confiança nas instituições públicas. Assim e mesmo que admitamos que a insolvência se lhes pode aplicar pretendemos propor alternativas que além de salvaguardar a coerência, confiança e segurança no ordenamento jurídico também proporcionem uma tutela da posição jurídica dos credores e terceiros garantes mais eficiente. | pt_PT |
| dc.description.abstract | The figure of local companies in general, and in particular of municipal companies, has been gaining more and more relevance over the years. These companies are an extension of the participating public entities that integrate the public administration. We then perceive that the issue of insolvency to these kind of companies raises questions about the coherence of the Portuguese legal system, security and trust in public institutions. Thus, and even if we admit that insolvency can be applied to them, we intend to propose alternatives that, in addition to safeguarding the coherence, trust and security in the legal system, also provide a more effective protection of the legal position of creditors and third parties. | en |
