A presente pesquisa tem como objetivo perceber como os normativos jurídicos dos Países Africanos de Língua Oficial Portuguesa (PALOP), especificamente as Constituições e os Planos Nacionais da Cultura, compreendem e legitimam a diversidade cultural. Este estudo exploratório fará uso da literatura especializada
antropológico-jurídica das últimas décadas, de maneira a questionar o papel dadisciplina na atualidade.
No âmbito jurídico, serão utilizados preceitos provindos da Teoria Crítica do Direito, contrastantes com a ideia positivista e dogmática de Direito a que a Modernidade sepropunha. Ademais, para evitar incorrer em pareceres superficiais e exoticistas, tratar-se-á a alteridade por uma perspectiva decolonial, essencial para a libertação de uma cultura dita periférica. Para tanto, considerar-se-ão técnicas de análise documental de conteúdo, de forma a sistematizar as informações coletadas entre categorias de unidade ou de diversidade cultural.
A partir disto, notar-se-á a existência ou não do desprendimento de estruturas e formas de dominação social e cultural, visto que os Estados incutidos na pesquisa possuem um passado colonial comum. Tal análise permitirá a percepção de possíveis padrões relativos aos modelos de democracia cultural ou de democratização da cultura, essenciais para visualizar a compreensão e a recepção do interculturalismo e da
colonialidade nos marcos jurídicos e políticas culturais em questão.
This research aims to understand how the legal norms of Portuguese-speaking African Countries (PALOP), specifically the Constitutions and National Culture Plans, understand and legitimize cultural diversity. This exploratory study will make use of the specialized anthropological-legal literature of the last decades, in order to question the role of the discipline today. In the legal field, precepts from the Critical Theory of Law will be used, contrasting with the positivist and dogmatic idea of Law proposed by Modernity. Furthermore, to avoid incurring superficial and exotic opinions, alterity will be treated from a decolonial perspective, essential for the liberation of a so-called peripheral culture. Therefore, content analysis techniques will be considered, in order to systematize the information collected between categories of cultural unity or cultural diversity. From this, it will be noticed the existence or not of the detachment of structures and forms of social and cultural domination, since the States inserted in the research have a common colonial past. Such analysis will allow the perception of possible patterns related to the models of cultural democracy or democratization of culture, essential to visualize the understanding and reception of interculturalism and coloniality in the legal frameworks and cultural policies in question.
