Qual é a posição dos Estados Unidos nos dias de hoje, em relação aos direitos humanos, mais propriamente, em relação ao direito à não tortura? Ao longo dos tempos, os Estados Unidos têm tomado medidas que colocam em causa os princípios salvaguardados pela Declaração Universal dos Direitos Humanos. O terrorismo tornouse um dos principais motivos, para que os direitos humanos conquistados no passado, estejam hoje a ser violados, por países que fazem deles os seus ideais, como é o caso dos Estados Unidos. O crime da tortura é proibido por diversos instrumentos internacionais, porém esta prática ainda é recorrente como forma de combater o terrorismo. Deve-se desculpar e encontrar exceções para este crime, quando este à luz dos instrumentos internacionais é reconhecido como um direito absoluto? Pretende-se, então, nesta dissertação, compreender como é tratado o crime da tortura a nível internacional e como os Estados Unidos aplicam as suas reservas, declarações e entendimentos que levam a limitar a obrigação dos Estados Unidos, perante o direito internacional.
What is the position of the USA nowadays in relation to human rights, more precisely, in relation to the right to non-torture? Throughout the ages, the USA has taken measures to put into question the principles safeguarded by the Universal Declaration of Human Rights. Terrorism has become one of the main reasons for the current violation of human rights, already conquered in the past, by countries that make them their ideals, for example the USA. The crime of torture, is prohibited by several international instruments, however, this practice is still recurrent as a way to combat terrorism. Should we apologize and find exceptions to this crime, when in the eyes of international instruments this is recognised as a absolute right? This dissertation, intends to understand how the crime of torture is dealt with in an international level, and how the USA applies its reserves, declarations and understandings, that lead to limiting the obligation of the USA, towards the international law.
