O fenómeno das alterações climáticas carateriza-se enquanto um dos principais desafios perante a comunidade internacional atualmente. O constante desenvolvimento da litigância climática e da aceção científica dos efeitos adversos das alterações climáticas nos Direitos Humanos deram resultado a num novo fenómeno de casos de “climate rights”, através dos quais os indivíduos vêm apresentar demandas climáticas à luz de argumentos de Direito Internacional dos Direitos Humanos. Este fenómeno surge, não apenas enquanto um mero “gap filler” para os remédios climáticos, mas enquanto um verdadeiro reconhecimento jurisdicional dos impactos das alterações climáticas nos Direitos Humanos. Este fenómeno veio desafiar, pela primeira vez, o sistema do Conselho da Europa, que se viu confrontado com complexas questões de substância e de admissibilidade perante a jurisdição de Estrasburgo. A presente dissertação apresenta um estudo das principais questões suscitadas pelos casos climáticos perante o Tribunal Europeu dos Direitos Humanos, através de uma análise dos precedentes jurisprudenciais e doutrinários e das posições adotadas pelo Tribunal de Estrasburgo em cada questão. Deste estudo resulta uma análise crítica sobre as decisões do Tribunal Europeu de Direitos Humanos e que impacto estas têm na construção dos “greening human rights” perante a Convenção Europeia dos Direitos Humanos e no futuro da litigância climática à luz do Direito Internacional dos Direitos Humanos.
The climate change phenomenon is one of the main challenges defying the contemporary international community. The constant development of climate change litigation and the scientific acceptance of the adverse effects of climate change on Human Rights has resulted in a new phenomenon of “climate rights” cases in which individuals come to present climate claims in the light of International Human Rights Law arguments. This phenomenon has emerged not merely as a “gap filler” for climate change remedies but as a genuine jurisdictional recognition of the climate change impacts on Human Rights. Climate rights cases have, for the first time, faced the Council of Europe system, bringing complex questions of substance and admissibility before Strasbourg’s jurisdiction. This dissertation presents a study of the main issues raised by climate cases before the European Court of Human Rights through an analysis of jurisprudence and doctrine that preceded the recent decisions and the positions adopted by the Court. This study leads to a final critical analysis of the European Court of Human Rights’ decisions and their impact on the construction of “greening" human rights before the European Convention on Human Rights and the future of climate change litigation in the lights of International Human Rights Law.
