A matéria fundiária constitui um tema sempre presente no universo singular da memória humana, cuja análise propicia os desafios que instigaram o nosso interesse e a determinação em retratá-los, inicialmente sob as malhas da legislação passada, mas obviamente o repto centra-se na complexidade evidenciada com o novo quadro jusfundiário, realidade associada ao nosso Direito positivo e, ao mesmo tempo, á actual ciência normativa, cujo cenário permitiu a elaboração de juízos com elementos valiosos para melhor concatenação de raciocínios com lastro para muitas discussões. Efectivamente, só deste modo podemos alcançar uma visão abrangente e satisfatória desta candente temática que se encontra nas agendas e nos debates actuais. Por isso mesmo, esta dissertação está comprometida com sucessivas considerações controvertidas, conteúdos, características, conceitos e posições, em virtude da importância que a matéria alcança no âmbito dos direitos reais. Desde logo, de maneira ampla aqui se encontra a nossa área de interesse – o Direito Fundiário de Angola –, a mola de investigação e avanço da matéria que nos ocupa. É na verdade nessa teia de questões sobre o qual vamos actuar, numa tentativa de oferecer respostas às indagações do quotidiano, sem dispensar a contribuição de outros saberes, já que a ciência inapelavelmente não tem força impositiva, antes deve aceitar as transformações verificadas na cadeia da sua própria evolução. Espera-se, assim, no mais justo sentido das palavras, que cada um dos intervenientes nas relações desta natureza e sobretudo as estruturas institucionais, possam redireccionar a sua actuação em convergência com um melhor manejo prático do conjunto de instrumentos legais de ordem fundiária, para contornar as inúmeras situações que se cruzam na vida real.
Land issues have always been a hot topic in the singular memory of human universe, such analysis and challenges, motivated our interest in studding the subject, initially under the legislation of the past. Nonetheless, the challenge is focused in the complexity evidenced with the new legislation and jusfundiary, associating the reality to our positive law and, in the same time, to the current normative science, in which scenario we elaborated judgments with valuable elements, to better link our thinking and opening opportunities further discussions. In fact, only seeing the issue in this angle can achieve a comprehensive and satisfactory view of this critical subject, which is on agenda and very current or actual. Thus, this dissertation is committed with successive conflicting considerations, contents, characterizations, concepts and positions, due to the importance that the topic reaches under real rights. Therefore, broadly here is our area of interest – The Land Law of Angolan – or Agrarian Law of Angola, which is the main object of our investigation and the advancement the subject that concerns us. In fact, it is in this web of questions under which we want to act, in an attempt to answer some questions, apparently simples ones, without ignoring the contribution of others, since science has relentlessly imposing power, firstly it should accept the changes in its own evolution. It is expected, in the true sense of the word, that each of the actors in the relations of this nature and especially the institutional structures can redirect its actions on convergence with better management of practices set of legal instruments of land in order to get around such numerous situations that intersect in real life.
