O estudo aqui desenvolvido tem como objeto analisar o emprego abusivo do poder económico em detrimento da igualdade de oportunidades entre os competidores no processo eleitoral. A ideia principal é examinar a projeção do referido princípio na organização de uma estrutura jurídica capaz de inibir ao máximo a influência corrosiva do dinheiro sobre o jogo democrático. Dessa forma, pretendemos demonstrar a necessidade de ação do Direito Eleitoral como promotor de um ambiente igualitário de disputa, tendo por base a realidade das democracias contemporâneas. Para isso, sem perder de vista os aspetos histórico-políticos, buscamos compreender o modo pelo qual o abuso de poder se apresenta como agente nocivo à igualdade de condições entre os competidores eleitorais, culminando na compreensão da sua manifestação económica quando aplicada para desequilibrar a disputa. Diante disso, traçaremos um esboço de medidas jurídicas direcionadas para reposição da igualdade perante a força do poder económico, bem como defenderemos a ação do Estado como impulsionador de ações prestacionais que visem compensar situações de desigualdade fática entre os candidatos.
This study has the purpose of analyzing the abusive application of economic power at the expense of equal opportunities among competitors in the electoral process. The main idea is to examine the projection of the mentioned principle in the organization of a legal framework capable to inhibit the most of the corrosive influence of money on the democratic game. Thereby, we intend to demonstrate the need of the electoral law action as the prosecutor of an egalitarian disputing environment, based on the reality of contemporary democracies. In order to accomplish this, without disregarding the historical-political aspects, we aim to understand the way in which the abuse of power appears as a harmful agent to equal conditions between electoral competitors, culminating in the understanding of its economic manifestation when used to unbalance the dispute. Before this, we will trace an outline of legal measures targeted for replacement of equality before the economic power force, as well as advocate the government action as the driving force behind aimed at compensate real inequality situations among the candidates.
