A presente tese tem como objetivo estudar a formação do Estado português durante a Idade Média, tendo o reinado de D. Manuel I como ponto de chegada. Identifica os elementos do Estado português que vão aflorando no curso da história dos sucessivos reinados, da Idade Média à Idade Moderna. Durante o reinado de D. Manuel I, Portugal passou por transformações políticas, económicas e culturais, convertendo-se em um império com governança global. Foram estabelecidas instituições administrativas e judiciais eficientes, com incentivo à formação de centros de produção do conhecimento científico. O estudo das características modernas do Estado português durante esse período é relevante tanto do ponto de vista político quanto jurídico, pois permitiu ao Estado enfrentar os desafios impostos pela exploração marítima e pela expansão colonial, fortalecendo a autoridade régia e o exercício do poder central. A pesquisa utiliza uma metodologia de análise crítica de doutrinas e estudos empíricos, com revisão bibliográfica e análise das fontes documentais coevas. Por conclusão, o reinado de Dom Manuel I consolidou o Estado português e formou o Estado Moderno, criando uma burocracia estatal administrativa, financeira, jurisdicional e normativa impessoal.
This thesis aims to study the formation of the Portuguese State during the Middle Ages, with the reign of King Manuel I as the point of arrival. It identifies the elements of the Portuguese State that emerge in the course of the history of successive reigns, from the Middle Ages to the Modern Age. During the reign of King Manuel I, Portugal underwent political, economic and cultural transformations, becoming an empire with global governance. Efficient administrative and judicial institutions were established, encouraging the formation of centers for the production of scientific knowledge. The study of the modern characteristics of the Portuguese State during this period is relevant from both a political and legal point of view, as it allowed the State to face the challenges imposed by maritime exploration and colonial expansion, strengthening royal authority and the exercise of central power. The research uses a methodology of critical analysis of doctrines and empirical studies, with bibliographic review and analysis of contemporary documentary sources. In conclusion, the reign of Dom Manuel I consolidated the Portuguese State and laid the foundations of the Modern State, creating an impersonal administrative, financial, jurisdictional and normative state bureaucracy.
