A evolução da responsabilidade do transportador aéreo e o legítimo interesse de defesa dos direitos dos passageiros, levaram a um crescimento estonteante de Convenções, Acordos Internacionais e Regulamentos Comunitários, que visaram equilibrar o interesse das partes contratantes de um contrato de transporte aéreo. Conseguiram estabelecer a ordem, tutelando os direitos do consumidor (passageiro), sem que tal onerasse em demasia as transportadoras aéreas, permitindo o progresso desta indústria. Com a dissertação aqui apresentada, pretendo analisar a responsabilidade do transportador aéreo perante danos que possa causar aos passageiros, e estudar sobre as suas principais fontes, para que qualquer consumidor possa garantir a
defesa dos seus direitos.
The evolution of the liability of the air carrier and the legitimate interest in the protection of passengers' rights have led to a growth of Conventions, International Agreements and Community Regulations aimed at balancing the insterests of the contracting parties to an air transport contract. They were able to establish order, safeguarding the rights of the consumer (passenger), without this overcharging the air carriers, allowing the progress of this new industry. With this dissertation, I intend to analyze the liability of the air carrier against damages that may be caused to the passengers, and to study its main sources, so that any consumer can guarantee the defense of his rights.
