| dc.description.abstract | O artigo analisa a vida, a obra e a influĂȘncia de claus-Wilhelm canaris (1937-2021), professor de Direito civil e de Direito comercial na Ludwig-Maximilians-UniversitĂ€t de Munique. A sua obra cobre ĂĄreas extensas da metodologia do Direito, do Direito civil e do Direito comercial e traduziu-se em cerca de duzentos tĂtulos publicados. Canaris desenvolveu, em especial, uma CiĂȘncia do Direito que pĂŽs cobro Ă separação entre a metodologia jurĂdica e o Direito concretamente aplicado. associando o pensamento filosĂłfico, em especial de cariz neo-hegeliano, Ă s decisĂ”es judiciais representativas de problemas reais, Canaris conseguiu avanços significativos no campo da tutela da confiança e na delimitação Ă©tica do exercĂcio dos direitos. desenvolveu, ainda, trabalhos relevantes no campo dos contratos, da responsabilidade civil, do enriquecimento injusto e do Direito comercial. Teve uma grande influĂȘncia na Alemanha, designadamente pelo seu papel na grande reforma do CĂłdigo Civil alemĂŁo de 2001. Canaris obteve um reconhecimento internacional, traduzido em diversos doutoramentos honoris causa; o primeiro foi-lhe concedido pela Universidade de Lisboa. Diversas obras suas foram traduzidas em portuguĂȘs, com larga difusĂŁo no Brasil. O papel de Canaris no Direito civil portuguĂȘs concretizou-se ainda atravĂ©s de contributos de professores da Faculdade de Direito de Lisboa que, ao longo dos anos, conduziram investigaçÔes em Munique. Nessa linha, a partir dos finais do sĂ©culo XX, a jurisprudĂȘncia lusĂłfona, dos dois lados do atlĂąntico, tornou-se irreconhecĂvel: passou a sindicar as diversas soluçÔes Ă luz dos valores fundamentais do sistema jurĂdico. | pt_PT |
| dc.description.abstract | This article examines the life, work and influence of Claus-Wilhelm Canaris (1937-2021), professor of Civil and Commercial Law at the Ludwig-Maximilians-UniversitĂ€t of Munich. In around two hundred published titles, his work deals with broad areas of legal methodology, Civil Law and Commercial Law. In particular, Canaris developed an approach to legal science that did away with the separation between legal methodology and law as actually applied. By applying philosophical, and especially neo-Hegelian, thought to representative judicial decisions on real issues, Canaris achieved significant progress in the field of legitimate expectations and the ethical delimitation of the exercise of rights. His work was also significant in the fields of contracts, civil liability, unjust enrichment and Commercial Law. He was highly influential in Germany and played an important role in the great reform of the German civil code in 2001. Canaris enjoyed an international reputation, and was awarded several honorary doctorates; the first of these was from the University of Lisbon. Several of his works have been translated into Portuguese, gaining a wide readership in Brazil. Canarisâ role in Portuguese civil law can also be seen in the contributions of teaching staff at the Lisbon Law Faculty who, over the years, have conducted their research in Munich. This was a process in which, as from the late twentieth century, Portuguese-language jurisprudence, on both sides of the atlantic, evolved out of all recognition and started to examine the different solutions in the light of the fundamental values of the legal system. | pt_PT |
